美国缺陷食品召回制度研究

【摘要】:近年来,苏丹红、毒豇豆、地沟油、三聚氰胺奶、瘦肉精、染色馒头等一系列食品安全事件的发生,让我国消费者对食品安全与卫生问题产生了巨大的质疑和危机感,严重影响了社会的稳定和食品的国际竞争力;而且,对于我国出口到国外的缺陷食品,已经建立健全了食品召回制度的国家就可以严格按照它们的法律程序要求我国食品生产经营者召回,而对于外国出口到我国的缺陷食品,由于我国的食品召回制度才刚刚起步,还存在很多缺陷,因此无法顺利、快捷的要求国外生产经营者召回他们的缺陷食品,这不仅会严重损害我国消费者的生命财产安全,而且对我国的食品生产经营者也是不公平的。 目前,美国的食品召回制度已经形成了比较完备的体系,可以说在国际上是最为先进的,因此,为保护我国消费者的生命财产安全权以及出口企业的贸易公平权,有必要对美国缺陷食品召回制度进行研究。 为此,首先主要介绍美国食品召回制度的相关概念,召回的分类及特点,以对美国食品召回制度作个初步的分析。其次,介绍美国食品召回制度的主要内容,并着重阐述了其法律程序和技术支撑体系,法律程序包括一般程序和简易程序,技术支撑体系包括食品安全标准、食品风险评估、食品安全检测、食品标签管理与信息溯源、食品召回保险等,以便对美国食品召回制度作更深层次的分析。最后,分析了我国食品召回制度的现状,并依照前面的论述以对我国食品召回制度的立法完善提供借鉴意义。
[Abstract]:In recent years, the occurrence of a series of food safety incidents, such as Sudan red, poisonous cowpea, gutter oil, melamine milk, lean meat essence, and dyed steamed bread, has made Chinese consumers have a huge suspicion and a sense of crisis about food safety and hygiene issues. It has seriously affected the social stability and the international competitiveness of food products. Moreover, for the defective food products exported by our country to foreign countries, Countries that have established and improved the food recall system can strictly comply with their legal procedures to require China's food producers and operators to recall. For defective foods exported to China from foreign countries, the food recall system in China has only just started. There are still many defects, so it is not possible to smoothly and quickly request foreign producers and operators to recall their defective food. This will not only seriously damage the life and property safety of consumers in our country, And to our country food production operator is also unfair. At present, the food recall system in the United States has formed a relatively complete system, which can be said to be the most advanced in the world. Therefore, in order to protect the right of life and property safety of Chinese consumers and the right to trade fairness of export enterprises, It is necessary to study the recall system of defective food in the United States. Therefore, first of all, it mainly introduces the related concepts, classification and characteristics of the food recall system in the United States, in order to make a preliminary analysis of the food recall system in the United States. Secondly, it introduces the main contents of the food recall system in the United States. The legal procedure and technical support system, which includes general procedure and summary procedure, includes food safety standard, food risk assessment, food safety detection, food label management and information traceability. In order to make a deeper analysis of the food recall system in the United States, the article analyzes the current situation of the food recall system in China, and provides a reference for the legislative perfection of the food recall system in our country according to the previous discussion.
