实证考察农民传统习俗对农村纠纷解决的影响及法律对策

【摘要】：中国的现代化进程越来越快,就需要越来越高程度的法制与之发展相适应。法治薄弱的农村占中国版图的绝大部分,法制意识淡漠的农民也占中国人口构成的绝大部分,这一直都被认为是我国法治现代化进程的障碍因素之一。随着社会经济的发展和交往的日益频繁,农村纠纷也在不断增多,依靠传统的途径已难以满足救济的需要,因而迫切需要我们提出解决农村纠纷的新途径。笔者以实证考察为基础,而提出相对应的法律对策,为完善并促进农村地区法治的建立略尽绵薄之力。文章首先从A村的传统习俗之形式着手,剖析传统习俗在村民解决法律纠纷时所产生的能动作用；其次阐述A村此种传统习俗所产生的原因,即现有的政治经济体制、文化体制、村民意识及行为模式等,并结合与当前中国其他发达地区的情况之对比,分析此种传统习俗在现代法治国家中解决农村纠纷的优缺点；文章的最后是笔者以上述之分析为条件,提出的一种建设性倡议。笔者始终认为,社会发展趋势必然是法治,而不是人治；但在转型期的中国,特别是在某些以熟人社会为主要特点的欠发达地区,笔者以为要更好的解决农村法律纠纷,应当建立“贤人”体制作为过渡机制,而在解决某些纠纷时出现的空白,建立相对应的法律体制,即以“贤人”为主,法律为辅之体制,并此二种体制的相互作用下,完善与其配套之机制。
[Abstract]:As China's modernization progresses faster and faster, it needs a higher and higher level of legal system to adapt to its development. The rural areas where the rule of law is weak constitute the vast majority of China's territory, and the majority of China's population is composed of peasants who are not aware of the rule of law. This has always been regarded as one of the obstacles to the modernization of the rule of law in China. With the development of social economy and increasingly frequent exchanges, rural disputes are also increasing, relying on traditional means has been difficult to meet the needs of relief. Therefore, it is urgent for us to put forward a new way to solve the rural disputes. Based on the empirical investigation, the author puts forward corresponding legal countermeasures, which can do little to perfect and promote the establishment of the rule of law in rural areas. The article begins with the form of traditional customs in Village A, analyzes the dynamic role of traditional customs in resolving legal disputes among villagers, and then expounds the causes of this kind of traditional customs in Village A, that is, the existing political and economic system. Cultural system, villager consciousness and behavior model, and combining with the current situation of other developed areas in China, this paper analyzes the advantages and disadvantages of this traditional custom in solving rural disputes in modern countries ruled by law; The last part of the article is a constructive proposal based on the above analysis. The author always believes that the trend of social development must be the rule of law, not the rule of man, but in China in the transition period, Especially in some underdeveloped areas characterized by acquaintance society, the author thinks that in order to better solve the legal disputes in rural areas, we should establish the "virtuous person" system as a transitional mechanism, and the gap in resolving some disputes. Establish the corresponding legal system, that is, the "virtuous people" as the main system, supplemented by the law, and under the interaction of these two systems, improve the supporting mechanism.
