社会管理创新法治问题研究

【摘要】：目前，我国正处转型时期，无论是经济制度还是政治制度，都面临着前所未有的挑战，社会管理工作亦是如此。本文研究社会管理创新中的法治问题，立足社会管理创新，以促进社会管理法治的发展，推进社会主义法治建设；同时明确社会管理创新的法治底线，保障社会管理创新的健康有序运行。本文首先介绍了社会管理和社会管理创新的概念之后，指出社会管理创新的任务与目标是协调社会关系、缓和社会矛盾、维护社会公平正义及社会稳定。其次从法律的视角对社会管理创新进行了解读，得出对政府权力的限制是社会管理创新的关键一环、以保障公民权利为核心、以实现社会公平正义为价值追求、以创立和谐社会为目的，进而指出社会管理创新与法治之间具有一定冲突，法治具有规范性、稳定性、权威性等特性，而创新意味着变革，具有创新性、变动性、超前性。虽然社会管理创新与法治之间存在冲突和矛盾，但两者在本质上仍是协调一致的。有了法治，社会管理创新才具有合法性、权威性、可预期性。且法治能为社会管理创新保驾护航。而后阐释了我国社会管理创新法治化的理论和实践基础，，同时指出目前我国社会管理创新法治化立法理念、立法形式、实质、执法司法守法上均存在一定问题。最后，探讨了我国社会管理创新法治化的路径，指出我国社会管理创新法治化建设，必须转变立法理念、完善立法、执法、司法和守法，才能真正实现我国社会管理创新法治化。
[Abstract]:At present, our country is in the period of transition, whether economic system or political system, are facing unprecedented challenges, social management work is the same. This paper studies the rule of law in social management innovation, based on social management innovation, In order to promote the development of the rule of law in social management, to promote the construction of socialist rule of law, and at the same time to make clear the legal bottom line of social management innovation, and to ensure the healthy and orderly operation of social management innovation. After introducing the concept of social management and social management innovation, this paper points out that the task and goal of social management innovation is to coordinate social relations, ease social contradictions, maintain social fairness and justice and social stability. Secondly, the author interprets the innovation of social management from the perspective of law, and concludes that the restriction of government power is the key link of social management innovation, with the protection of civil rights as the core, and the realization of social fairness and justice as the value pursuit. In order to create a harmonious society, it is pointed out that there is a certain conflict between social management innovation and the rule of law. The rule of law has the characteristics of standardization, stability and authority, while innovation means change, innovation and variability. Although there are conflicts and contradictions between social management innovation and the rule of law, they are still consistent in nature. With the rule of law, social management innovation has legitimacy and authority. And the rule of law can protect the social management innovation. Then it explains the theoretical and practical basis of the legalization of social management innovation in our country. At the same time, it points out the legislative idea, the legislative form and the essence of the social management innovation in our country at present. There are some problems in the administration of justice. Finally, this paper discusses the path of legalization of social management innovation in our country, and points out that the construction of legalization of social management innovation in our country must change the legislative idea, perfect legislation, enforce law, administer justice and abide by the law. Only then can we truly realize the rule of law of social management innovation in our country.
