反智主义思潮与当代中国法治话语体系之构建

【摘要】：反智主义是一种发源于美国20世纪50年代的社会思潮。反智第一层含义是怀疑、反对知识和知识分子;第二层含义是对尚未达成共识的社会秩序的拒绝态度。反智主义作为一种社会存在,有其必然性和合理性。社会对反智主义正反情感并存。当代中国法治话语体系的构建是一项伟大的中国法治实践。作为一个社会系统,在构建时既要分析系统内在的要素特质,又要考虑其与所处环境信息交换的过程。反智主义所内含的怀疑态度、权利意识、理性精神本身就应是中国法治话语体系的构成要素,其内在的矛盾与冲突也必然对当下中国法治话语体系构建产生一定的影响。反智主义思潮的分析与反思对构建当代中国法治话语体系具有促进和借鉴作用。
[Abstract]:Anti-intellectualism is a social trend of thought that originated in America in the 1950 s.The first implication of anti-wisdom is to doubt, to oppose knowledge and intellectuals, and the second is to reject the social order that has not been agreed upon.As a kind of social existence, anti-intellectualism has its inevitability and rationality.The society has both positive and negative feelings for anti-intellectualism.The construction of the discourse system of the rule of law in contemporary China is a great practice of the rule of law in China.As a social system, it is necessary to analyze the characteristics of the elements of the system and to consider the process of exchanging information between the system and the environment.The skepticism, the consciousness of right and the spirit of reason contained in anti-intellectualism should be the constituent elements of Chinese legal discourse system, and its internal contradictions and conflicts must have a certain influence on the construction of Chinese legal discourse system at present.The analysis and reflection of anti-intellectual thoughts can promote and draw lessons from the construction of the discourse system of rule of law in contemporary China.
