马克思主义中国化历史进程中的法律思想研究

【摘要】：马克思主义中国化的历史进程就是马克思主义法律思想中国化的历史进程。以毛泽东、邓小平、江泽民、胡锦涛为代表的中国共产党人，以马克思主义经典作家的法律思想、中国优秀传统文化中的法律思想为理论渊源，将马克思主义法律思想的基本原理与中国革命和建设的具体实际相结合，形成了适合于中国国情的毛泽东法律思想、邓小平法律思想、江泽民法律思想、胡锦涛法律思想的思想体系，即形成了中国化马克思主义法律思想，丰富和发展了马克思主义法律思想。其中，中国特色社会主义法律体系是马克思主义中国化历史进程中马克思主义法律思想中国化的最新理论成果。 本文沿着马克思主义中国化历史进程的发展来阐述各个阶段马克思主义法律思想中国化的成果。在马克思主义中国化的历史进程中，，毛泽东法律思想是马克思主义法律思想中国化的开端，为中国特色社会主义法律思想体系的形成提供了理论基础；邓小平法律思想是马克思主义法律思想中国化的发展，为社会主义的建设和发展提供了法律保障；江泽民法律思想是马克思主义法律思想中国化的深化，实现了中国共产党治国方略和执政方式的转变；胡锦涛法律思想是马克思主义法律思想中国化的创新，中国特色社会主义法律体系的形成，开创了中国化马克思主义法律思想发展的新篇章。这些法律思想是一脉相承的，是继承与发展的关系。中国化马克思主义法律思想必然随着中国特色社会主义实践的发展不断向前推进。 马克思主义中国化历史进程中的法律思想的发展，给予我们重要启示。中国化马克思主义法律思想的发展，一定要坚持马克思主义法律思想的基本原理不动摇，坚持中国共产党的领导，坚持实事求是和群众路线，坚持市场经济和民主政治，坚持宪法法律至上，法律建设要在前进中求稳，并坚持发展和完善社会主义法律体系。
[Abstract]:The historical process of Marxism in China is the historical process of the Sinicization of Marxist legal thought.The Communist Party of China, represented by Mao Zedong, Deng Xiaoping, Jiang Zemin and Jiang Zemin, takes the legal thought of the classic Marxist writers and the legal thought in China's excellent traditional culture as its theoretical origin.By combining the basic principles of Marxist legal thought with the concrete reality of China's revolution and construction, we have formed Mao Zedong's legal thought, Deng Xiaoping's legal thought and Jiang Zemin's legal thought, which are suitable for China's national conditions.The ideological system of Hu Jintao's legal thought, that is, formed the Marxist legal thought in China, enriched and developed the Marxist legal thought.Among them, the legal system of socialism with Chinese characteristics is the latest theoretical achievement of the Sinicization of Marxist legal thought in the historical process of Marxism's Sinicization.This paper expounds the achievements of the Sinicization of Marxist legal thought in each stage along with the development of the historical process of Sinicization of Marxism.In the historical process of Marxism in China, Mao Zedong's legal thought is the beginning of the Sinicization of Marxist legal thought, which provides the theoretical basis for the formation of socialist legal thought system with Chinese characteristics.Deng Xiaoping's legal thought is the development of Marxist legal thought in China, which provides legal guarantee for the construction and development of socialism.Hu Jintao's legal thought is an innovation of Marxist legal thought in China and the formation of a socialist legal system with Chinese characteristics.Opened a new chapter in the development of Marxist legal thought in China.These legal thoughts are inherited in the same vein and are the relationship between inheritance and development.With the development of socialism with Chinese characteristics, the legal thought of Marxism in China will advance continuously.The development of the legal thought in the historical process of Marxism in China gives us important enlightenment.The development of Marxist legal thought in China must adhere to the basic principles of Marxist legal thought, adhere to the leadership of the Communist Party of China, adhere to the line of seeking truth from facts and the mass line, and adhere to the market economy and democratic politics.To uphold the supremacy of constitutional law, we must seek stability in the course of legal construction, and persist in developing and perfecting the socialist legal system.
