刑事证据制度的法美学思考

【摘要】：法律美学是一门新兴的边缘法学学科,它是美学与法学相互交叉而产生的。法律美学主要是利用美学的观点和方法去研究法,追求法律在真、善、美三方面的统一,追求法律与社会生活其他方面的和谐。法律科学通常研究“法律之真”、“法律之善”,而忽略对“法律之美”的研究。法律美学正是对法律之美等问题进行集中的研究与探讨。在大部分人看来,法律是理性的。法律总是给人一种严肃、严谨的印象,很难与“美”联系在一起。实际上,虽然法律偏重理性思考,却也包含着对美的追求,法律是人类为了创造美好生活而运用的一种手段。法律与人们追求的美之间有着天然的联系,“法之美”的问题越来越受到关注。法律的美通过具体的法律规定、法律制度体现出来,关系到法治社会中每一个公民的切身利益。作者试图从法律美学的角度理解我国的刑事证据制度,使人们在刑事证据制度的运用实践中,树立一种审美立场,借以推动刑事证据制度的改革与完善。本文将围绕刑事证据制度与法美学之间的联系,以刑事证据制度既要体现求真、求善的一般要求,又要体现求美的最高要求,指出刑事证据制度可以成为法美学的研究对象,具备审美条件。刑事证据制度与其它法律制度一样,还具备一定的美学性质,不仅是人类审美意识的一种体现,也是人类审美意识的载体,并且遵循着法美学的规律,体现出人类的审美追求。同时,刑事证据制度所追求的法美学目标不仅有内在内容之美,也有外在形式之美,法美学对法律制度之美的追求是内在与外在的统一。作者还从中国刑事证据制度的起源、规范、程序等具体方面阐述其是如何发生审美观念的变迁的。文章最后一部分作者结合2012年3月新修改的刑事诉讼法中关于刑事证据方面的修改部分,分析我国刑事证据制度之美的完善。
[Abstract]:Legal aesthetics is a new frontier subject of law, which is produced by the intersection of aesthetics and law.The aesthetics of law mainly uses the viewpoint and method of aesthetics to study the law, pursue the unity of truth, goodness and beauty of law, and pursue the harmony between law and other aspects of social life.The science of law usually studies the truth of law and the goodness of law, while neglecting the study of beauty of law.The aesthetics of law studies and probes into the beauty of law.To most people, the law is rational.The law always gives a serious, rigorous impression that it is hard to relate to beauty.In fact, although the law emphasizes rational thinking, it also contains the pursuit of beauty. Law is a means used by human beings to create a good life.There is a natural connection between law and the beauty that people pursue, and the issue of "beauty of law" has been paid more and more attention.The beauty of law is embodied by specific legal regulations, which is related to the vital interests of every citizen in a society ruled by law.The author tries to understand the criminal evidence system in China from the angle of legal aesthetics so that people can set up an aesthetic stand in the practice of criminal evidence system so as to promote the reform and perfection of the criminal evidence system.This paper will focus on the connection between the criminal evidence system and the aesthetics of law, and point out that the criminal evidence system can become the research object of the aesthetics of law.Having the aesthetic condition.The criminal evidence system, like other legal systems, has a certain aesthetic nature, which is not only a reflection of human aesthetic consciousness, but also a carrier of human aesthetic consciousness, and follows the law of legal aesthetics, reflecting the aesthetic pursuit of human beings.At the same time, the criminal evidence system pursues not only the beauty of internal content, but also the beauty of external form. The pursuit of the beauty of legal system in legal aesthetics is the unity of internal and external.The author also expounds how the Chinese criminal evidence system changes its aesthetic concept from the aspects of its origin, standardization, procedure and so on.In the last part of the article, the author analyzes the perfection of the criminal evidence system in our country in the light of the revised part of criminal procedure law in March 2012.
