【摘要】：在法律解释学说的发展过程中,由萨维尼阐发的经典法律解释学说无疑占据举足轻重的地位。经典法律解释理论的“四要素”,也成为当今法律解释学方法体系构成的基础。随着法学解释理论研究的深入发展,“四要素”中的文义要素、历史要素和体系要素已经逐步演化为当代法律解释体系中极其重要的方法,而逻辑要素却因过于专注文本的逻辑自足、忽略法律规范与事实的复杂联系而倍受诟病。即便如此,将逻辑要素武断的排除在解释方法的体系之外也有因小失大之嫌。本文结合国内外学者的相关研究和司法实践情况,以民法为视角,较为系统的阐述了逻辑要素对当代解释学说的方法论意义。为了深入研究这一问题,本文主要运用了案例分析、中外比较、类比归纳等研究方法。本文认为,逻辑要素是当代法律解释理论不可或缺的构成部分,大多数的法律解释方法的构成和适用都无法脱离逻辑而完成。因此,在我国的法律实践中,应该加大对逻辑要素的重视程度。本文共分三个章节: 本文第一章主要介绍逻辑要素在经典法律解释学说中的含义与功能,指出了它与其他三要素之间的逻辑关系。简要介绍了“四要素”理论的历史局限性及其对逻辑要素未来发展的影响。在第二章中,首先介绍了当代解释学说中的诸方法由“四要素”演变而来的过程,力求从历史渊源的角度对解释方法体系做一纵向的交代;之后,还对构成当今法律解释学说的主要解释方法进行了简要的说明。第三章作为本文的核心部分,先简要的介绍了学界对形式逻辑作为解释学说要素的各种质疑;之后分别从宏观和微观两个层面探讨逻辑要素对法律解释学说的重要作用。在宏观层面上,重点探讨逻辑要素对厘清法律解释方法的位阶顺序中所起到的指导作用;在微观层面上,本文将结合具体案例着重分析逻辑要素是如何在各解释方法适用过程中起作用的。
[Abstract]:In the course of the development of the theory of legal interpretation, the classical theory of legal interpretation explained by Savini undoubtedly occupies a pivotal position.The four elements of the classical theory of legal interpretation have also become the basis of the legal hermeneutics system.With the further development of the theory of legal interpretation, the elements of literary meaning, historical elements and system elements in the four elements have gradually evolved into extremely important methods in the contemporary legal interpretation system.However, the logical elements are criticized for focusing too much on the logical self-sufficiency of the text and neglecting the complicated connection between legal norms and facts.Even so, the arbitrary exclusion of logical elements from the system of methods of interpretation is a mistake.Based on the relevant research and judicial practice of scholars at home and abroad, this paper systematically expounds the methodological significance of logic elements to contemporary interpretation theory from the perspective of civil law.In order to study this problem deeply, this paper mainly uses the case analysis, the Chinese and foreign comparison, the analogy induction and so on research method.This paper holds that logical elements are indispensable components of contemporary theory of legal interpretation, and most of the methods of legal interpretation can not be completed without logic.Therefore, in our legal practice, we should pay more attention to logical elements.This paper is divided into three chapters:The first chapter mainly introduces the meaning and function of logic elements in the classical legal interpretation theory, and points out the logical relationship between the logic elements and the other three elements.This paper briefly introduces the historical limitations of the "four elements" theory and its influence on the future development of logical elements.In the second chapter, the author first introduces the evolution of the methods in the contemporary hermeneutical theory from the "four elements", and tries to make a vertical explanation of the interpretation method system from the angle of historical origin.In addition, the main interpretation methods that constitute the current legal interpretation theory are briefly explained.The third chapter, as the core part of this paper, first briefly introduces the academic circles of formal logic as the interpretation of the elements of various doubts, and then from the macro and micro levels to explore the important role of logical elements on the theory of legal interpretation.At the macro level, it focuses on the guiding role of logical elements in clarifying the order of legal interpretation methods; at the micro level,This paper will focus on how the logical elements play an important role in the application of each interpretation method.
