法治进程中道德约束机制的缺失及其克服

【摘要】：随着我国法治建设的发展,对影响法治进程的各种阻碍性因素的研究也日益重要与迫切。因道德缺失产生的各种社会现象以及道德缺失对法治进程的影响和后果已经成为当今法治建设中必须解决的问题,本文在对道德缺失的深层原因和和道德缺失对中国法治建设的影响以及由此产生的各种社会问题进行深层次分析基础上,从文化与信仰的视角提出了解决道德缺失问题的几点建议,指出发扬传统文化和正确发挥信仰在建设道德体系中的积极作用与意义,通过建设道德体系来完善道德对法治建设的支撑作用,以使法治的推进拥有良好的道德背景,从而完善法治建设。
[Abstract]:With the development of China's legal construction, has become more and more important and urgent to research the influence of the process of the rule of law hindering factors. Various social phenomena caused by the lack of morality and ethics influence on the development of the rule of law and the consequences have become must solve today's problems in the construction of the rule of law, makes a deep analysis of the influence of the rule of law based China in the construction of the deep reason of lack of moral and moral deficiency and the resulting social problems, some suggestions to solve the lack of moral problems from the culture and belief perspective, pointed out that carrying forward the traditional culture and the right to play a positive role and significance in the construction of moral belief system, to improve the supporting role of the rule of law and moral the construction of the construction of moral system, to promote the rule of good moral background, so as to improve the construction of the rule of law.
