全面依法治国视角下旅游法治研究

【摘要】：党的十八大提出,法治是治国理政的基本方式,要加快建设社会主义法治国家,全面推进依法治国。2014年10月,中共十八届四中全会首次专题讨论了依法治国问题,通过了《中共中央关于全面推进依法治国重大问题的决定》,重申了依法治国重要思想,法律成为治国之重器,在推进依法治国的过程中,旅游法治建设是其中的重要内容,在此大背景下,十二届全国人大常委会制定了旅游法。旅游业具有“无烟工业”和“永远的朝阳产业”的美称,对于扩大就业、增加税收都有着十分重要的意义。进入21世纪以来,我国旅游业迅速发展并不断与国际旅游业接轨,用法律手段来规范、引导、保障旅游业健康稳定发展,是符合当今我国促进经济发展与法治社会建设的现状要求。完善的旅游业法制体系是“依法治旅”的前提和保障,然而目前我国旅游业法治建设相对落后,一些复杂性,综合性强的旅游问题依然存在。本文主要是在全面依法治国大背景下对旅游法治建设的研究,首先是从对全面依法治国,旅游法治以及旅游法相关概述着手,紧接着阐述了全面依法治国与旅游法治研究的关系;之后从建设社会主义法治国家的需要,保护旅游者合法权益的需要,保护我国旅游资源的需要,发展旅游业尤其是国际旅游业的需要四个方面阐述了在我国实施旅游法治建设的必要性;接着重点论述了法治思维、法治原则对旅游法治建设中旅游市场主体的法律思维以及应坚守的原则的指导;最后阐述的是文章的重点,从旅游立法存在的问题,执法中存在的问题,司法中存在的问题,旅游参与者法律意识存在的问题几个方面论述了旅游法治建设当前存在的问题,并对问题产生原因进行了分析,之后从完善立法工作,加强执法环节,优化旅游司法机制,教育公众提高守法意识四个方面对我国旅游法律环境的改善进行了论述。笔者希望通过对当前旅游法治建设中存在的问题以及对产生问题的原因进行分析,可以提出关于完善我国旅游法治建设的建设性建议。
[Abstract]:The 18th National Congress of the CPC put forward that the rule of law is the basic way of governing the country, it is necessary to speed up the construction of a socialist country ruled by law and comprehensively promote the rule of law. In October 2014, the fourth Plenary session of the 18th CPC Central Committee discussed the issue of governing the country according to law for the first time. Through the "decision of the CPC Central Committee on comprehensively promoting the important issue of governing the country according to Law," the important idea of governing the country according to law is reiterated, and the law has become a heavy instrument for governing the country. In the process of promoting the rule of law, the construction of the tourism rule of law is an important part of it. In this context, the 12 th National people's Congress standing Committee formulated a tourism law. Tourism has the reputation of "smokeless industry" and "eternal sunrise industry", which is of great significance for expanding employment and increasing tax revenue. Since the beginning of the 21st century, China's tourism industry has developed rapidly and been in line with the international tourism industry. The legal means are used to standardize and guide the tourism industry to ensure the healthy and stable development of the tourism industry. It is in line with the current requirements of our country to promote economic development and the construction of a society ruled by law. The perfect legal system of tourism is the premise and guarantee of "governing tourism according to law". However, at present, the construction of rule of law in tourism industry in China is relatively backward, some complex and comprehensive tourism problems still exist. This paper mainly studies the construction of tourism rule of law under the background of ruling the country by law in an all-round way, first of all, it begins with an overview of the overall rule of law, tourism rule of law and tourism law. Then, the paper expounds the relationship between the comprehensive rule of law and the study of tourism rule of law, and then from the needs of building a socialist country ruled by law, the need to protect the legitimate rights and interests of tourists, and the need to protect the tourism resources of our country. This paper expounds the necessity of the construction of tourism rule of law in our country in four aspects of the development of tourism, especially the need of international tourism, and then focuses on the thinking of the rule of law. The principle of rule of law should guide the legal thinking of the subject of tourism market and the principle that should be adhered to in the construction of tourism rule of law. Finally, the article focuses on the problems existing in the tourism legislation, the problems in law enforcement, and the problems in the administration of justice. This paper discusses the problems existing in the construction of tourism rule of law in several aspects, analyzes the causes of the problems, and then improves the legislative work, strengthens the law enforcement links, and optimizes the tourism judicial mechanism. This paper discusses the improvement of the legal environment of tourism in China from four aspects: educating the public to raise the consciousness of abiding by the law. The author hopes that through the analysis of the problems existing in the construction of tourism rule of law and the causes of the problems, the author can put forward some constructive suggestions on how to perfect the construction of tourism rule of law in China.
