论法律解释方法的规范性质及功能

【摘要】：解释具有不同的意义。法律解释方法只是狭义解释项下操作性解释中的一个范畴。它是法官或法律适用者证成其法律决定所依赖的大前提即法律规范的一个理由,是确定怎样运用法的渊源与法律解释结果相关联的规准或规范。对于法官或法律适用者的法律解释活动或行为来说,法律解释方法是一种调整性规范,是具有原则性质的规范。它们是证成法律决定的一种形式理由,是一种预先假定的前提,是保证大前提从法的渊源推论出来的一种转换规则,能够保证法律解释结果以及法律决定的可预测性、确定性,能够增长法律决定的理性。
[Abstract]:Interpretation has different meanings. The method of legal interpretation is only one category of operational interpretation under narrow interpretation. It is a reason for a judge or a person who applies the law to prove that the legal decision depends on the premise of the legal norm. It is a criterion or norm that determines how to use the source of the law and the result of the interpretation of the law. The law interpretation method is a kind of regulative norm, and it is the norm with the nature of principle for the law interpretation activity or behavior of the judge or the law applicator. They are a formal reason for legal decision, a presupposition premise, a conversion rule inferred from the origin of law, and can guarantee the predictability and certainty of legal interpretation and legal decision. Can increase the rationality of legal decisions.
