美国植物药专利保护模式的法律探究

【摘要】：近年来，因为以单一化学成分为主的西药已不能满足治疗现代复杂病症的需求，国际医药市场对含有多种成份的天然药物的需求迅速增长。中药作为我国传统文化的瑰宝，，正面临着走向世界的难得机遇为使我国中医药在走向世界的同时，能够得到专利制度的有效保护，本论文主要运用比较研究方法，探讨了中药与植物药的差异，以及从从中美专利法对药品保护的角度探究了美国专利法对植物药的保护模式。其研究目的在于指出现行专利制度不利于保护中药的问题所在，并通过比较研究提出有利于保护我国中药的法律建议。
[Abstract]:In recent years, due to the fact that the western medicine with a single chemical component is no longer able to meet the demand for the treatment of modern complex diseases, the demand for natural medicines with many components has been increasing rapidly in the international medicine market. As the treasure of Chinese traditional culture, Chinese medicine is facing a rare opportunity to go to the world. In order to make Chinese traditional medicine go to the world and get the effective protection of patent system, this paper mainly uses comparative research method to discuss the difference between traditional Chinese medicine and plant medicine. And from the point of view of the patent law of China and the United States, this paper explores the protection mode of the patent law of the United States for plant drugs. The purpose of this study is to point out that the current patent system is not conducive to the protection of traditional Chinese medicine, and to put forward some legal suggestions for the protection of Chinese traditional medicine through comparative study.
