法治中国需破解的重大难题——李林教授的学术轨迹和学术思想管窥

【摘要】：正改革开放以来,我国法治建设取得了举世瞩目的成就,法治在保障人权、规范权力、推动改革、促进发展、维护稳定、实现公平正义等方面发挥了重要作用,但有法不依、执法不严、违法不究现象在一些地方和部门依然存在,关系人民群众切身利益的执法司法问题还比较突出,一些公职人员滥用职权、失职渎职、执法犯法甚至徇私枉法严重损害国家法治权威,这些现象和问题引起了中央领导同志的高度重视。面对这样的难题,国内法学家们纷纷建言献策,分析查找原因,比较有代表性
[Abstract]:Since the reform and opening up, the construction of the rule of law in our country has made remarkable achievements. The rule of law has played an important role in safeguarding human rights, standardizing power, promoting reform, promoting development, maintaining stability, realizing fairness and justice, etc. The phenomenon of lax enforcement of the law and impunity for violations of the law still exists in some localities and departments. The issue of law enforcement and administration of justice, which concerns the vital interests of the people, is still quite prominent. Some public officials abuse their powers and derelict their duties and dereliction of duty. Breaking the law and even perverting the law for favoritism seriously impairs the authority of the state's rule of law, and these phenomena and problems have aroused the great attention of leading comrades of the central government. In the face of such a difficult problem, domestic jurists have put forward suggestions one after another, analyzed the reasons for finding out, and are more representative.
