法律词语的概念化——以我国刑法词语为例

【摘要】：借鉴词汇概念和认知模式理论,以我国刑法词语为例证,探讨法律词语的词汇认知表征和概念化模式。通过研究发现,法律词语的概念化是以语言系统和概念系统的交互与融合为特征的动态语义建构过程。在法律语境和法律行为因果关系的制约作用下,法律词语的词汇概念经过选择与融合机制,激活了相应的法律行为事件认知模式。词汇概念与认知模式的组构与整合使不同类型的法律词语形义匹配体进行细微调整或重新匹配,进而协调不同概念化主体的认知差异,实现一致性语义的建构。
[Abstract]:Based on the theory of lexical concept and cognitive model, this paper discusses the lexical cognitive representation and conceptualization model of legal words, taking Chinese criminal law words as an example. It is found that the conceptualization of legal words is a dynamic semantic construction process characterized by the interaction and fusion of language system and conceptual system. Under the restriction of the legal context and the causality of legal acts, the lexical concepts of legal words have been selected and merged, thus activating the corresponding cognitive mode of the events of legal acts. The construction and integration of lexical concepts and cognitive models make different types of legal words and meanings match slightly or rematch, and then coordinate the cognitive differences of different conceptualized subjects and realize the construction of consistency semantics.
