清初理学名臣汤斌的执法观探析

【摘要】：清初是一个动荡的时代，社会各方面矛盾、冲突不断，而汤斌(1627——1687)作为政府官员，在整饬官吏执法方面，建树颇多。笔者通过研究其整饬执法的行为，总结出其执法观的具体内容，即执法应务实严谨、公正廉明、讲求效率、以民为本，以及其执法观的特点，即实践性。不可否认的是，由于所处时代的特殊性，其执法观深受封建理学思想的影响，有一定的历史局限性，但从其执法观与具体执法行为结合后取得的实效上看，其执法观是符合法律要求的。同时，笔者还通过比较其执法观和现代执法观的贯彻方式，进而得出贯彻执法观须以“法治”的方式为基础，，并善用“人治”的方式为补充，方能取得最好效果的结论，笔者认为汤斌所采用的方式对于我国执法观的建设有借鉴意义。
[Abstract]:The early Qing Dynasty was a turbulent time with contradictions and conflicts in various aspects of the society. As a government official, Tang Bin made a lot of achievements in rectifying the law enforcement of officials. By studying its behavior of rectifying the law enforcement, the author summarizes the concrete contents of his law enforcement view, that is, the law enforcement should be practical and rigorous, fair and honest, efficient, people-oriented, and the characteristics of its law enforcement view, that is, practicality. It is undeniable that due to the particularity of the times, the law enforcement concept is deeply influenced by the feudal Neo-Confucianism and has some historical limitations. However, from the point of view of the actual results obtained after the combination of its law enforcement concept and specific law enforcement actions, Its view of law enforcement is in line with the requirements of the law. At the same time, the author compares his law enforcement view with the modern law enforcement view, and then draws the conclusion that the implementation of the law enforcement view should be based on the "rule of law" mode and be supplemented by the "rule of man" mode, in order to achieve the best results. The author believes that the way adopted by Tang Bin has reference significance for the construction of law enforcement concept in our country.
