列宁法制统一思想及其实践价值

【摘要】：苏俄十月革命胜利后,多民族的俄罗斯传统中固有的地方主义一定程度上影响着新生苏维埃国家政权的巩固和法制统一的实施。为了实现整个苏维埃共和国境内法制统一,列宁认为,要制定反映人民意志的国家根本大法宪法,确立国家法制统一的基准;完善法律体系,构筑国家法制统一的基本前提;保证公民守法、行政机关严格执行和法院公正司法是国家法制统一的关键实施环节;设立检察机关厉行法律监督,则是国家法制统一的制度保障。形成于苏俄革命胜利初期的列宁法制统一思想,对于当下仍处于社会主义初级阶段社会转型期的中国,如何消解地方主义和部门主义的负面影响,维护国家法制统一权威,仍然具有重要的理论意义和实践借鉴价值。
[Abstract]:After the victory of the Soviet Union's October Revolution, the localization inherent in the multi-ethnic Russian tradition affected to some extent the consolidation of the state power of the new Soviet Union and the implementation of the unification of the legal system. In order to realize the unification of the legal system in the whole Soviet Republic, Lenin believed that it is necessary to formulate the constitution of the fundamental law of the country which reflects the will of the people, to establish the standard of the unification of the national legal system, to perfect the legal system, and to build the basic premise of the unification of the national legal system The key link of the unification of the national legal system is to ensure the citizens to abide by the law, the administrative organs to strictly enforce the law, and the courts to just judicature, while the establishment of procuratorial organs to enforce the legal supervision is the system guarantee of the unification of the state legal system. Lenin's idea of legal unification, which was formed in the early stage of the Soviet Revolution, is how to eliminate the negative influence of regionalism and secularism and maintain the authority of the unification of the state's legal system in China, which is still in the transition period of the socialist primary stage. Still has the important theory significance and the practice uses for reference the value.
