论习惯法的规范性分析

【摘要】：习惯法规范性的分析分为两个层次:一是对日常生活中习惯法的初加工,所采用的是语言转换的方法;二是对描述性习惯法的再加工,所采用的是规范实证的方法。基于语言转换方法,本文构筑了一部农业雇佣习惯的成文法;基于规范实证的方法,本文分析了习惯规则的模式类型、习惯规则的内部要素和习惯原则的类型。
[Abstract]:The normative analysis of customary law can be divided into two levels: one is the initial processing of customary law in daily life, the other is the method of language conversion; the other is the reprocessing of descriptive customary law, which adopts the method of normative demonstration. Based on the method of language conversion, this paper constructs a statutory law of agricultural employment habits. Based on the normative empirical method, this paper analyzes the pattern types of customary rules, the internal elements of customary rules and the types of customary principles.
