南非消费者权益保护制度研究

【摘要】:南非作为非洲大陆上经济最为发达的发展中国家,与中国有着密切的贸易往来,其消费者权益保护法与其贸易政策的高度相关性,使我们有必要对其消费者权益保护法予以高度关注,以便在更好保护我国公民自身利益的前提下实现经济活动的目标。但是国内尚没有关于南非消费者权益保护制度的研究,在经济一体化和全球化的时代,我国对南非消费者权益保护制度的研究具有重要意义。 南非消费者权益保护制度的发展经历了一段很长的时间,种族隔离制度的结束为南非消费者权益的保护提供了可能,自南非新政府成立以来,颁布了一系列有关消费者权益保护的单行法律,并在吸收各国消费者保护立法经验的基础上不断修改了其国内法律的框架,其中2009年颁布实施《消费者权益保护法》就是南非消费者权益保护制度的核心内容。该法统一了全国各省的消费者权益保护的标准,通过约束不合理的市场行为并建立纠纷解决机制来实现消费市场的公平、有序、健康,该立法体系完整,内容全面,既包括实体性内容,也包含程序性规定。实体性的内容包括消费者的概念、消费者权利以及供应商的义务。南非《消费者权益保护法》为供应商设定了严格的责任制度,供应商的义务从传统意义上的保障消费者公平、安全商品和服务,扩展到了负有促进环境保护等具有新时代特色的义务。 程序性制度介绍了具有监督执法职能的消费者权益保护组织,主要包括国家消费者委员会、国家信贷管理机构、省级消费者权益保护组织以及非政府组织的职能介绍。在纠纷解决机制中,南非政府较为重视非诉讼方式的解决,国家消费者委员会作为一个新设立的机构,在处理消费者投诉以及促进纠纷的调解上扮演着重要的角色,仲裁以及行政申诉的运用也加快了消费纠纷的解决。另外,诉讼解决方式作为最终的救济方式有效地为消费者提供了司法保护,这也是保障消费者权益保护法实施效果的关键。 南非曾经是一个存在严重种族主义的国家,为了彻底消除种族歧视制度给南非国家带来的影响,在大力发展本国经济的同时,甚为重视国家人权保护的立法建设。其中完善消费者权益保护制度,对消费者实行平等的保护,并为消费者创造良好的市场环境,既体现了对人权的重视,也能进一步加速南非经济发展的步伐。本文旨在展示南非消费者权益保护制度的立法风范之余,为我国企业在南非投资贸易给予法律上的指导,减少在非华商的经济损失,还希望可以为我国消费者权益保护制度的完善,提供南非成功的立法经验以及立法技术。
[Abstract]:South Africa, as the most economically developed developing country on the African continent, has close trade ties with China, and its consumer rights and interests protection law is highly relevant to its trade policy. It is necessary for us to pay close attention to the protection of consumer rights and interests so as to realize the goal of economic activities on the premise of better protecting our citizens' own interests. However, there is no research on the system of consumer protection in South Africa. In the era of economic integration and globalization, it is of great significance for our country to study the system of consumer protection in South Africa. The development of consumer rights protection system in South Africa has been going through a long time. The end of apartheid has made it possible to protect the rights of consumers in South Africa. Since the establishment of the new government in South Africa, Having enacted a series of separate laws on the protection of consumer rights and interests and continuously revising the framework of their domestic laws based on the experience of national consumer protection legislation, In 2009, the enactment and implementation of the Consumer Rights and interests Protection Act is the core content of the consumer rights protection system in South Africa. The law unifies the standards for the protection of consumer rights and interests in all provinces of the country, and realizes the fairness, order and health of the consumer market by restricting unreasonable market behavior and establishing a dispute resolution mechanism. The legislative system is complete and the content is comprehensive. Both substantive content and procedural provisions are included. Substantive content includes the concept of consumers, consumer rights and supplier obligations. South Africa's Consumer Rights and interests Protection Act sets a strict liability system for suppliers, whose obligations are traditionally to protect consumers' fairness, safety, and goods and services. Extended to the responsibility to promote environmental protection and other features of the new era. The procedural system introduces the functions of consumer rights and interests protection organizations with the function of supervising and enforcing the law, including the National Consumer Council, the State Credit Management Agency, the provincial consumer rights protection organizations and non-governmental organizations. In the dispute resolution mechanism, the South African government attaches more importance to non-litigation resolution, and the National Consumer Council, as a newly established body, plays an important role in handling consumer complaints and promoting mediation of disputes. Arbitration and the use of administrative complaints have also accelerated the resolution of consumer disputes. In addition, as the final remedy, litigation solution provides judicial protection for consumers effectively, which is the key to protect the enforcement effect of consumer rights and interests protection law. South Africa was once a country with serious racism. In order to completely eliminate the influence of racial discrimination system on South African country, it attaches great importance to the legislative construction of national human rights protection while vigorously developing its own economy. Perfecting the system of protecting consumers' rights and interests, implementing equal protection to consumers and creating a good market environment for consumers not only embody the importance of human rights, but also accelerate the pace of economic development in South Africa. The purpose of this paper is to show the legislative style of the consumer protection system in South Africa, to provide legal guidance for Chinese enterprises to invest and trade in South Africa, and to reduce the economic losses of non-Chinese businessmen. It also hopes to provide South Africa's successful legislative experience and technology for the perfection of consumer rights protection system in China.
