新世纪中国共产党依法治国思想及实践途径研究

【摘要】：新中国成立以来,中国共产党为了建设社会主义民主和法制,带领人民不断进行探索和实践,取得了成就,也走了弯路。从党的十一届三中全会开始,中国共产党明确提出,发展社会主义民主、健全社会主义法治;十五大更是把依法治国作为治理国家的基本方略,把建设社会主义法治国家确立为社会主义现代化目标;党的十六大明确提出,发展社会主义民主政治,最根本的就是要把坚持党的领导、人民当家做主和依法治国有机统一起来;党的十七大强调要全面落实依法治国的基本方略;2010年中国已形成了以宪法为核心的中国特色社会主义法律体系。新世纪以来,我党进一步加快了依法治国的步伐,2012年12月4日,在我国确立宪法日的纪念大会上,习近平明确提出“捍卫宪法尊严”、“保证宪法实施”;2014年党的十八届四中全会通过了《关于全面推进依法治国若干重大问题的决定》,明确提出全面依法治国,开启了中国特色社会主义法治道路的新征程。新世纪以来中国共产党法治思想主要包括:依宪治国的思想;全面依法治国的思想、坚持党的领导、人民当家做主、依法治国有机统一的思想、坚持依法治国和以德治国相结合的和谐法治思想、坚持依法执政的思想等;在实践中,确立了依法治国的指导方针,即科学立法、严格执法、公正司法、全民守法;明确了依法治国的途径,即加强党的领导全面从严治党是根本保证、加强法制建设是基础、坚持普法教育是有效措施、加强法治队伍建设是关键、推进政治体制改革是保障。当前中国特色社会主义法律体系已经形成,法治政府建设稳步推进,司法体制不断完善。但是有法不依的情况仍然比较严重,执法不严、违法不究的情况也比较突出,全社会的法律意识和法治观念还不强。因此加强宪法实施推进科学立法、加快法治政府建设、保证公正司法公信力、增强全民法治观念推进法治社会建设就成为当前和今后依法治国的重要任务。
[Abstract]:Since the founding of the people's Republic of China, the Communist Party of China has made achievements and taken a detour in order to build socialist democracy and legal system. Starting with the third Plenary session of the 11th CPC Central Committee, the Communist Party of China has clearly proposed to develop socialist democracy and improve the socialist rule of law; and the 15th National Congress has taken the rule of law as the basic strategy for governing the country. Establishing the building of a socialist country ruled by law as the goal of socialist modernization, the 16th National Congress of the Party clearly stated that the most fundamental thing in developing socialist democratic politics is to adhere to the leadership of the Party. The Seventeenth National Congress of the Communist Party of China stressed the need to implement the basic strategy of governing the country according to law in an all-round way. In 2010, China has formed a socialist legal system with Chinese characteristics at the core of the Constitution. Since the new century, our Party has further quickened the pace of administering the country according to law. On December 4, 2012, at the commemorative meeting of China's Constitution Day, Xi Jinping explicitly proposed "safeguarding the dignity of the Constitution". In 2014, the fourth Plenary session of the 18th CPC Central Committee adopted the "decision on promoting the Rule of Law in an All-round way," which clearly put forward a new journey on the road of ruling the country by law in an all-round manner, which opened up the road to socialist rule by law with Chinese characteristics. Since the new century, the Chinese Communist Party's thought of ruling by law mainly includes the thought of governing the country according to the constitution, the thought of governing the country according to law in an all-round way, the idea of adhering to the leadership of the Party, the people being the master of the country, and the idea of organically unifying In practice, the guiding principle of governing the country according to law is established, that is, scientific legislation, strict law enforcement, just administration of justice, and the law of the whole people. It is clear that strengthening the leadership of the Party is the fundamental guarantee, strengthening the construction of the legal system is the foundation, persisting in the education of law popularization is an effective measure, strengthening the construction of the ranks of the rule of law is the key, and promoting the reform of the political system is the guarantee. At present, the socialist legal system with Chinese characteristics has been formed, the construction of the government ruled by law has been steadily advanced, and the judicial system has been continuously improved. However, the situation of not obeying the law is still serious, the law enforcement is not strict, the law is not prosecuted, and the whole society's legal consciousness and the concept of rule by law are not strong. Therefore, strengthening the implementation of the Constitution to promote scientific legislation, speeding up the construction of the government ruled by law, ensuring the credibility of justice and justice, and strengthening the concept of the rule of law among the people to promote the construction of a society ruled by law have become an important task of administering the country according to law
