南宋范应铃法律思想探析——以《名公书判清明集》为中心

【摘要】：范应铃是南宋一位深明法理又不失人情的判官。他长期在地方任职,深知民间疾苦,同时他深受儒学思想的熏陶,儒家伦理纲常的观念对他影响极深,故他在判案过程中特别注重法、理与情3者的结合。在《名公书判清明集》中,范应铃的判词直观反映了他重视法理、人情和同情弱者的法律思想。
[Abstract]:Fan Ying-ling was a judge of the Southern Song Dynasty. He worked in the local place for a long time, knew well the folk pain, at the same time he was deeply influenced by Confucianism thought, the Confucian ethics principle idea had a very deep influence on him, so he paid special attention to the combination of law, reason and emotion in the process of adjudicating a case. In the judgment of Ming and Ming Dynasty, Fan Ying-ling 's judgment intuitively reflects his legal thought of attaching importance to jurisprudence, human feelings and sympathy for the weak.
