从“对立”到“共生”:西方学术界的中国法律传统研究述论

【摘要】：通过反思西方学界关于中国法律传统的代表性研究,着重指出无论是冷战背景下将中西方法律对立,还是其后"发现"中国法律传统的"现代性"的尝试,其背后都与西方学术思潮和政治有密切的关系,西方学界对中国法律传统的研究无法脱离西方学术本身,亦可看到西方理论及其背后的价值预设对认识中国法律传统的误解。从"实践"出发,关注法律具体的运作,尝试融汇中西并寻求对诸多二元对立范畴的超越,是全球化时代背景下西方学术界中国法律传统研究的重要趋势。
[Abstract]:By reflecting on the representative research on Chinese legal tradition in western academic circles, this paper emphatically points out that whether it is against Chinese or Western law under the background of the Cold War, it is also an attempt to "discover" the "modernity" of Chinese legal tradition. Both of them are closely related to western academic thought and politics. The study of Chinese legal tradition in western academic circles can not be divorced from the western academic itself, and can also see the misunderstanding of western theory and its value presupposition in understanding Chinese legal tradition. Starting from "practice", paying attention to the specific operation of law, trying to merge Chinese and Western countries and seeking to transcend many dualistic opposing categories, it is an important trend for the western academic circles to study Chinese legal tradition under the background of globalization.
