【摘要】：随着中国经济的发展和法治的完善,地方立法迎来了蓬勃发展的春天。地方立法的核心和灵魂是地方特色。地方立法特色的价值包括补充价值、区域价值、创新价值以及培育价值,这些价值日益受到立法机关、专家学者和民众的重视和关注。而目前的状况是地方立法普遍缺乏特色,其原因主要包括自主权因素、重复性因素、技术性因素、规划性因素以及监督性因素。地方特色立法的实现状况有着深刻的影响因素,主要是地理因素、经济因素、管理因素和文化因素。地方立法特色是指地方立法在与中央立法保持一致的基础上,从本地自然环境、经济发展、民族风俗、文化水平等实际出发,总结实践经验,讲究立法创新,体现地方性和时代性,并注重可行性和操作性的一种特点。地方立法特色理论的核心在于其基本内涵和实现方法。地方立法特色的基本内涵包括地方立法的创新性、地方性、针对性和可行性。地方立法特色有着丰富的具体表现形式,如环保特色、民生特色、资源特色、教育特色、科技特色、经济特色、管理特色、文化特色、人口特色和旅游特色等。探寻切合本地民众生活的立法成为当代我国立法事业最为迫切的重大课题之一,对这一课题的深入研究和探讨必将对中国特色社会主义法治体系的发展和完善产生积极而深远的影响。
[Abstract]:With the development of Chinese economy and the perfection of the rule of law, local legislation has ushered in the spring of vigorous development. The core and soul of local legislation is local characteristics. The value of local legislative features includes complementary value, regional value, innovation value and cultivation value. These values have been paid more and more attention by the legislature, experts and scholars and the public. The current situation is that the local legislation is generally lack of characteristics, the main reasons include autonomy factors, repeatability factors, technical factors, planning factors and supervisory factors. The realization of local characteristic legislation has profound influence factors, mainly geographical factor, economic factor, management factor and cultural factor. The characteristic of local legislation is to sum up the practical experience and pay attention to the legislative innovation based on the reality of local natural environment, economic development, national customs, cultural level and so on, on the basis of keeping consistent with the central legislation. Embodies the locality and the time nature, and pays attention to the feasibility and the operability one kind of characteristic. The core of the characteristic theory of local legislation lies in its basic connotation and realization method. The basic connotation of local legislative features includes the innovation, locality, pertinence and feasibility of local legislation. Local legislative features have rich concrete forms, such as environmental protection, people's livelihood, resources, education, science and technology, economy, management, culture, population and tourism. It has become one of the most urgent and important topics in our country's legislative career to explore legislation suitable for the life of the local people. The in-depth study and discussion of this subject will have a positive and far-reaching impact on the development and improvement of the socialist legal system with Chinese characteristics.
