中韩对外贸易管理法比较研究

【摘要】：今年是中韩建交20周年。自1992年中韩建交以来，中韩两国不仅仅在国家关系上获得了长足发展，还在贸易交流上取得了重大的成果。对韩国而言，中国是其最重要的贸易伙伴之一。自1992年到2011年，两国之间的贸易突飞猛进地成长。其中2011年双边贸易额已达到2000亿美元1。因此，现在的韩国政府期待着两国的贸易在将来也继续如此成长下去。之所以现在需要研究中韩两国的对外贸易管理问题，一方面是因为2001年11月11日中国正式加入WTO，另一方面是因为中日韩首脑宣布展开围绕FTA（自由贸易协定）进行的谈判。中国对外贸易更大规模的开放，对韩国的企业而言是一种打进中国市场的机遇；对中国的企业而言，是一种开拓世界市场的机遇。一般而言，中韩对外贸易依赖度越高，对对外贸易法研究的重要性也越强。然而现今关于这方面的研究还存在相当不足。对外贸易法是一个国家管理对外贸易的基本法律，也是对国家政策评价的根据。因此，本文着眼于中韩两国的贸易发展，通过中韩对外贸易法比较研究分析评价两国对外贸易法的异同。本文主要是以中韩国际贸易管理法为研究对象，分析两国的对外贸易管理基本制度、包括对外贸易管理的基本原则、促进和限制进出口方面的相关制度，对外贸易秩序以及对外贸易调整。本文第一部分是国际贸易管理法概述和体系，澄清有关概念并做出一般性叙述；第二部分和第三部分分别介绍中国和韩国的对外贸易管理法，介绍其具体内容并概括其特点；第四部分是中韩贸易管理法比较，，更进一步地思考和分析两国法律不同特点背后的深层背景与逻辑；最后部分是结论。
[Abstract]:This year marks the 20th anniversary of the establishment of diplomatic relations between China and South Korea. Since the establishment of diplomatic relations between China and South Korea in 1992, China and South Korea have not only made great progress in national relations, but also made great achievements in trade exchanges. For South Korea, China is one of its most important trading partners. Trade between the two countries grew by leaps and bounds from 1992 to 2011. Bilateral trade reached $200 billion in 2011. Therefore, the current South Korean government is looking forward to the continued growth of trade between the two countries in the future. The reason why it is necessary to study the management of foreign trade between China and South Korea now, On the one hand, because China formally joined the WTO on November 11, 2001, and, on the other hand, because the heads of state of China, Japan, and South Korea announced the opening of negotiations around the FTA. China's foreign trade has been opened on a larger scale. For Korean enterprises, it is an opportunity to enter the Chinese market; for Chinese enterprises, it is an opportunity to open up the world market. Generally speaking, the higher the dependence on foreign trade between China and South Korea, the more important the research on foreign trade law. The foreign trade law is the basic law of a country to manage foreign trade, and it is also the basis of the evaluation of national policy. Therefore, this paper focuses on the trade development of China and South Korea, analyzes and evaluates the similarities and differences of the two countries' foreign trade laws through the comparative study of the foreign trade laws of China and South Korea. Analyzing the basic systems of foreign trade management of the two countries, including the basic principles of foreign trade management, promoting and restricting the relevant systems of import and export, The first part of this paper is an overview and system of the international trade management law, clarifies the related concepts and makes a general description. The second and third parts introduce the foreign trade management law of China and Korea respectively. The fourth part is the comparison of the trade management law between China and South Korea, further thinking and analyzing the deep background and logic behind the different characteristics of the two countries' laws; the last part is the conclusion.
