【摘要】：本文的写作目的在于以历史顺序考察我国古代土地所有权思想的基本内容之上,探索出我国传统法律文化中土地所有权思想的变迁规律,找到我国土地所有权制度可“依赖的历史路径”,总结各种所有权制度成功的经验和失败的教训,以期为我国农村土地权利制度的重构提供经验和借鉴。在综合运用历史分析、多元化和古今结合的研究方法基础上,本文从一种新颖的视角切入,为我国当前农村土地权利制度的改革提出以下创新性建议：一是要在现有农村土地集体所有的框架内,协调好国家、集体和农民三方的关系,改变现有国家力量畸强,而集体和农民力量畸弱的局面,应赋予农民更多的权利。二是要推进土地承包经营权的物权化,使土地承包经营权的权能法定化；同时要加强土地承包经营权流转自由的建设,使市场在农地资源配置中发挥主导作用。本文第一部分和第二部分以历史年代为主线,考察了我国传统法律文化中土地所有权思想的变迁历程。从纵向来看,并非单纯采用按朝代的历史分期法,而是以国家土地所有权与私有土地所有权“谁战谁胜”为根据,将我国历史划分为四个阶段：夏商周——春秋,战国——秦汉,魏晋南北朝——中唐,唐中后期——明清。历史分期本身并非重点,目的在于以这种方法更好地呈现国家土地所有权与私有土地所有权在这四个阶段的演化和发展。第三部分是对前两章内容进行系统梳理的基础上,总结出我国传统法律文化中土地所有权思想的演变规律。作为历史研究的现实意义,第四部分研究了我国现有农村土地权利的现状,以及历史与现行制度之间的继承,并进一步地提出了改革我国现行农村土地权利制度的可行性方案。
[Abstract]:The purpose of this paper is to investigate the basic content of the ancient land ownership thought in the historical order, and to explore the law of the change of the land ownership thought in the traditional legal culture of our country. To find out the historical path on which the land ownership system of our country can depend, and to sum up the successful experiences and lessons of the various ownership systems in order to provide experience and reference for the reconstruction of the rural land rights system in our country. On the basis of the comprehensive application of historical analysis, pluralism and the combination of ancient and modern research methods, this paper starts with a novel perspective. This paper puts forward the following innovative suggestions for the reform of the current system of rural land rights in China: first, it is necessary to coordinate the relationship between the state, the collective and the peasants within the framework of collective ownership of the existing rural land, and to change the existing national strength. The situation that collective and peasant forces are extremely weak should give peasants more rights. Second, it is necessary to promote the real right of land contract management right and legalize the power of land contract management right; at the same time, it is necessary to strengthen the free construction of land contract management right, so that the market can play a leading role in the allocation of agricultural land resources. The first part and the second part of this paper take the historical age as the main line, has inspected the change course of the land ownership thought in the traditional legal culture of our country. From the vertical point of view, the history of our country is divided into four stages: Xia, Shang, Zhou, Spring and Autumn, based on the national land ownership and private land ownership, which are divided into four stages: Xia, Shang Zhou, Spring and Autumn period. Warring States-Qin-Han, Wei, Jin, Southern and Northern dynasties-mid-Tang, Tang, late-Ming-Qing Dynasty. Historical staging itself is not the focus, the purpose of this method is to better present the evolution and development of national land ownership and private land ownership in these four stages. The third part summarizes the law of the evolution of the thought of land ownership in the traditional legal culture of our country on the basis of systematically combing the contents of the first two chapters. As the practical significance of the historical research, the fourth part studies the present situation of the rural land rights in our country, and the inheritance between the history and the current system, and further puts forward the feasible plan of reforming the current rural land rights system of our country.
