法律方法论学科的拓展——2016年中国法律方法论研究报告

【摘要】：在建设"双一流"背景之下,法律方法论作为一个独立法学分支学科的属性日益提升,2016年度的丰硕成果能够作为佐证。在理论基础方面,法律方法论不仅探究了以法教义学为代表的历史渊源,还持续关注了法治建设的重大现实问题。在法律方法论的分支学科中,法律解释学强调了制度完善和综合解释方法的运用;法律论证理论仍然凸显着法律修辞的研究成果,并继续与中国法治特点相结合;法律逻辑学强调了作为方法论的形式逻辑。在部门法方法论的研究中,突出的特点是行政法方法论产生了较多成果。基础理论和分支学科的提升与完善,都充实着法律方法论作为独立学科的地位。
[Abstract]:Under the background of "double first-class" construction, the attribute of law methodology as an independent branch of law has been promoted day by day. On the theoretical basis, the legal methodology not only explores the historical origin represented by the doctrine of law, but also continues to pay attention to the major practical problems in the construction of the rule of law. In the branch discipline of legal methodology, legal hermeneutics emphasizes the perfection of system and the application of comprehensive interpretation method, the theory of legal argumentation still highlights the research results of legal rhetoric and continues to combine with the characteristics of Chinese rule of law. Legal logic emphasizes formal logic as a methodology. In the research of departmental law methodology, the outstanding characteristic is that the methodology of administrative law has produced many achievements. The promotion and perfection of basic theory and branch discipline enrich the position of law methodology as an independent discipline.
