虚假新闻的法社会学分析

【摘要】：虚假新闻作为一个新闻公害早已引起包括新闻界有识之士在内诸多主体的关注和声讨,但梳检以往,我们仍不免会见虚假新闻于诸报之端,因此如何解决虚假新闻问题还以新闻真实一面是一个亟待解决的问题。兼具法学与社会学理论优势的法社会学研究对于众多社会问题的解决大有裨益,尤其是对于虚假新闻此类与社会现实紧密相关的新闻现象更是如此。本文从社会变迁等社会学理论视角入手,以法社会学研究方法,主要是理论研究的形式探讨虚假新闻的产生等各个方面,并探求治理虚假新闻的方案选择。 第一部分：在社会学视角下探索虚假新闻的内涵、产生原因与历程,并由此探索其背后的法律根源；从传统社会到现代法治社会是社会变迁的重要考察点,本部分突出展现晚清时期、民国时期及新中国成立后法律因素在虚假新闻社会变迁中的作用； 第二部分：面对愈演愈烈的虚假新闻之势,国家法的优势再次得以凸显。但介入到虚假新闻治理中的国家法不免与新闻业重要内容之一的新闻自由产生理论与现实的碰撞,而这两者之间的冲突及其平衡途径成为本部分的探讨的重要内容； 第三部分：该部分延续前一部分的理论脉络,将法律责任引入到对制造与传播虚假新闻的相关行为之中,通过对违法性的理论与现实两方面认知,对制造与传播虚假新闻的法律责任通过实现方式与免除两个方面作考察,以期在有限内容中明确法律责任的承担； 第四部分：解决虚假新闻的相关问题不仅有法社会学的理论呼吁,更有现实中的迫切需求,在前文科学理清虚假新闻相关核心内容基础之上,本部分为了明确治理虚假新闻的方向性,以社会系统理论为依据,初步建立了选择标准,并通过法律方案与其他方案的分类来详细论述虚假新闻治理的相关内容。
[Abstract]:As a news hazard, false news has long attracted the attention and condemnation of many subjects, including the people with insight in the press. But in the past, we still could not avoid meeting with false news at the end of the newspapers. Therefore, how to solve the problem of false news is a problem to be solved urgently. The research on sociology of law, which has the advantages of both jurisprudence and sociology, is of great benefit to the solution of many social problems, especially to the phenomenon of false news, which is closely related to social reality. From the perspective of sociological theory such as social change, this paper discusses the emergence of false news in the form of sociology of law, mainly in the form of theoretical research, and probes into the choice of solutions to deal with false news. The first part is to explore the connotation, cause and course of false news from the angle of sociology, and explore the legal root behind it, from traditional society to modern rule of law society, which is an important investigation point of social vicissitude. This part highlights the role of legal factors in the social changes of false news during the late Qing Dynasty, the Republic of China and after the founding of New China. The second part: facing the growing trend of false news, The advantages of national law are again highlighted. However, the state law involved in the governance of false news inevitably collides with the theory and reality of press freedom, which is one of the important contents of journalism, and the conflict between the two and its balanced approach become the important contents of this part. The third part: this part continues the previous part of the theoretical context, will be introduced into the legal liability of the production and dissemination of false news related acts, through the illegal theory and reality of the two aspects of cognition. To investigate the legal liability of manufacturing and disseminating false news by means of realization and exemption, in order to make clear the legal liability in the limited content; The fourth part: solving the related problems of false news is not only the theoretical appeal of sociology of law, but also the urgent need in reality. In order to clear the direction of the management of false news, based on the theory of social system, this part initially establishes the selection criteria, and discusses the relevant contents of the governance of false news in detail through the classification of legal schemes and other schemes.
