德法治理的应时逻辑——马克思主义法学探索之五

【摘要】：德法治理模式作为影响全人类的治理选择,是马克思主义法学关注的基本命题之一。德法治理选择来源于顺应时势要求的规则取舍和主辅规则之间的兼容空间。习近平总书记提出的依法治国与以德治国相结合思想,是契合时代趋势的基本要求的法主德辅模式,也是中华民族法治史上德法治理模式的新型阶段。从唯物史观揭示的社会发展规律来观照,德法走向一体化将成为社会趋势,"道德法"将成为规则手段演化的必然选项。作为这种趋势的上层反映,国家法治思想应顺应时势,适时取舍,提出全面法治的战略思想。
[Abstract]:The governing mode of German and French as a choice to influence all mankind is one of the basic propositions of the law of Marx. The choice of the governance of Germany and France comes from the compatible space between the rules and the rules of the main and auxiliary rules that conform to the demand of the current situation. The combination of the rule of law and the rule of virtue, which is proposed by general secretary Xi Jinping, is in accordance with the trend of the times. It is also a new stage of the German and German governance in the rule of law in the history of the Chinese nation. From the rule of social development revealed by the historical materialism, the integration of Germany and France will become a social trend, and the moral law will be the inevitable choice for the evolution of the rule means. As the upper reflection of this trend, the state rule of law thought We should adapt to the current situation and make timely choice, and put forward the strategic thinking of a comprehensive rule of law.
