论可持续发展原则对公法学的更新与重塑

【摘要】：可持续发展原则已经为诸多国家的公法规范和公法案例所肯定,成为公法的一项重要原则。由于可持续发展原则在公法上的重要价值,以公法现象和公法问题为志业的公法学理应对可持续发展作出回应。公法学研究的经典范式已经不适应可持续发展原则的需求,因而应根据可持续发展原则的需要进行更新,主要体现为公法学研究的逻辑起点从人的个体性转向人的公共性,公法学的研究思维从主体性思维转向主体间性思维。随着研究范式的更新,公法学的基本样态也在可持续发展原则的作用下得以重塑。
[Abstract]:The principle of sustainable development has been affirmed by the norms and cases of public law in many countries and has become an important principle of public law. Because of the important value of the principle of sustainable development in public law, the theory of public law, which regards the phenomenon and problem of public law as its core, should respond to the problem of sustainable development. The classical paradigm of the study of public law has not been adapted to the demand of the principle of sustainable development, so it should be updated according to the need of the principle of sustainable development, which is mainly reflected in the logical starting point of the study of public law from individual to public. The research thinking of public law turns from subjective thinking to intersubjective thinking. With the renewal of the research paradigm, the basic pattern of public law can also be reshaped under the action of the principle of sustainable development.
