【摘要】：当前,我国已进入全面建设小康社会的关键时期,新农村的建设是我们党提出的战略性的历史任务,是构建和谐社会的重要一环。法文化是一种综合性的文化载体,集中反映了意识、制度以及法律机构设施等各种法律的构成情况。文化是人类在社会历史发展进程中所创造的复合财富,其自身具备软实力要素：文化的承载力、发展力与张力。作为文化的下位概念,法文化也具备着软实力要素。农村法文化的承载力是农村现有法文化对农村经济、社会发展的支撑力;农村法文化的发展力是农村法文化自身发展的内在趋势和倾向性；农村法文化的张力对农村,乃至整个社会产生的强大的拉动作用。而当前我国农村地区的法文化的现状令人堪忧。农村地区的法文化整体上在中国传统法文化与外来法文化、农村地区的民间习惯与国家法等出现断裂,导致了当代农村的法文化已不能适应农村地区的科学发展。正是由于法文化的软实力以及当前法文化的断裂,在建设“生产发展、生活宽裕、乡风文明、村容整洁、管理民主”的新农村时,就必须要正式法文化的重构对于新农村建设的重要作用。全文共分为四个部分：第一部分分析了在当前建设社会主义新农时法文化的重要作用。通过分析法文化对农村市场经济、农村精神文明建设、农村民主政治以及社会公平正义方面的促进与保障作用,指出法文化对新农村建设的意义。法文化作为一种软实力,可以为农村的经济、社会等各个方面提供文化与制度层面上的保障与推动作用。第二部分着重指出当代农村法文化的现状。当前农村的法文化表现出诸多特性,从实质上讲,其是一种多元混合、多类并存的法文化。农村法文化是农村文化与国家文明互动统一的过程,是农村的封闭性与国家法的整体性的统一,也是农村传统与现代文明的统一。造成农村法文化不平衡的尴尬局面的原因是多方面的。小农经济的分散封闭性与市场经济的本质相背离,民间传统与国家法出现了断裂,西方法文化与中国传统法文化的断裂等方面是造成当代农村法文化断裂的根本原因。第三部分是文章的落脚点。在分析法文化对新农村建设的战略意义以及当代农村法文化与新农村建设的总体要求不相适应的前提下,提出农村法文化的重构。一方面,农村法文化重构的模式包括路径选择与主体支撑；另一方面,农村法文化重构包括现代法律意识的培育以及农村法律制度的完善。现代法律意识应该要体现“法律至上”的原则与“公平正义”的价值理念。要注重积极吸收外来法文化精髓,还要充分挖掘传统法文化的合理因素。文章从上诉角度探讨我国新农村建设中的农村法文化的重构问题,试图找到法文化与新农村建设的平衡点。
[Abstract]:At present, our country has entered the key period of building a well-off society in an all-round way. The construction of a new countryside is a strategic historical task put forward by our Party and an important part of building a harmonious society. Legal culture is a comprehensive cultural carrier, which reflects the constitution of various laws such as consciousness, system and legal institution. Culture is a complex wealth created by human beings in the course of social and historical development. It has its own elements of soft power: bearing capacity, developing force and tension of culture. As the inferior concept of culture, legal culture also has the element of soft power. The carrying capacity of the rural legal culture is the support of the rural legal culture to the rural economy and social development, the development of the rural legal culture is the inherent trend and tendency of the rural legal culture's own development, the tension of the rural legal culture has great influence on the rural areas. Even the whole society produces the powerful pull function. The current situation of legal culture in rural areas of China is worrying. As a whole, the law culture in rural areas is broken between Chinese traditional law culture and foreign law culture, and the folk custom and national law in rural areas, which leads to the fact that the law culture in rural areas has been unable to adapt to the scientific development of rural areas. It is precisely because of the soft power of the legal culture and the rupture of the current legal culture that a new countryside with "productive development, rich living, civilized style of the countryside, clean and tidy villages and democratic management" is being built. The reconstruction of formal legal culture must play an important role in the construction of new countryside. The paper is divided into four parts: the first part analyzes the important role of the new socialist agriculture culture. This paper points out the significance of law culture to the construction of new countryside through the promotion and protection of the culture of analysis to the rural market economy, the construction of rural spiritual civilization, the rural democratic politics and the social fairness and justice. As a kind of soft power, legal culture can provide cultural and institutional protection and promotion for all aspects of rural economy and society. The second part emphatically points out the present situation of the contemporary rural legal culture. At present, the legal culture in rural areas shows many characteristics. In essence, it is a kind of multi-mixed, multi-category co-existing legal culture. The rural legal culture is the process of the interaction and unification of the rural culture and the national civilization, the unity of the country's closeness and the national law, as well as the unity of the rural tradition and the modern civilization. There are many reasons for the imbalance of legal culture in rural areas. The dispersion and closeness of small peasant economy deviates from the essence of market economy, the folk tradition and the state law break up, the west method culture and the Chinese traditional law culture break down, and so on are the fundamental causes of the contemporary rural legal culture fracture. The third part is the foothold of the article. On the premise of the strategic significance of analytic culture to the construction of new countryside and the general requirements of contemporary rural legal culture and new rural construction, the reconstruction of rural legal culture is put forward. On the one hand, the mode of reconstruction of rural legal culture includes path choice and main body support; on the other hand, the reconstruction of rural legal culture includes the cultivation of modern legal consciousness and the perfection of rural legal system. Modern legal consciousness should embody the principle of "law first" and the value idea of "fairness and justice". Attention should be paid to the positive absorption of the essence of foreign legal culture and to fully excavate the reasonable factors of traditional legal culture. This paper discusses the reconstruction of rural legal culture in the construction of new countryside from the angle of appeal, and tries to find the balance point between law culture and new rural construction.
