论自媒体言论自由的法律边界

【摘要】：互联网的迅速发展为人们的生活带来了翻天覆地的变化,以网络为依托的自媒体更是打破了信息的传统传播方式,以其本身所具有的即时互动性、隐匿性、易操作性等特点,为公民言论自由权的实现提供了极好的平台。它让人人都享话语权,平民百姓都是“记者”变成了现实。自媒体言论在公民言论自由权获得尊重、推动知识进步和追求真理、推进我国民主进程方面都有着不可替代的作用。任何事物都有两面性,自媒体的出现为公民的言论自由增添了活力,但是一些侵犯公共利益及他人合法权益的行为也时常发生。因此,明确自媒体言论自由的法律边界变得越来越有必要。法律边界说到底就是法律的保护与限制问题,在边界内行使权利,应当受到保护,超越边界应当受到限制甚至惩罚。本文通过对自媒体言论相关概念的描述,并分析近年来与自媒体言论有关的案例,呈现出自媒体言论与其他权利的边界划定争议,以及借鉴其他国家关于言论自由的限制原则,然后分析我国对自媒体言论保护与限制措施的现状及不足之处,并从立法和行业自律这两个方面提出可行性建议,使言论自由权利人在权利范围内行使权利并受保护,相关权力机关在公民超越权利的行使范围时对其进行限制,并把握好限制的度,最终使自媒体言论朝着更加规范的方向发展。笔者认为法律边界的实质其实就是自由与秩序的关系问题,在自由与秩序的博弈中,找到两者的平衡点,实现两者并存的最佳状态,最大限度的实现公民的言论自由权。
[Abstract]:The rapid development of the Internet has brought great changes to the people's life. The self media based on the Internet has broken the traditional way of communication, with its own characteristics such as instant interaction, concealment, easy operation and so on. It provides an excellent platform for the realization of the freedom of speech of citizens. It allows everyone to enjoy the words. It has an irreplaceable role in the respect of citizens' right to freedom of speech, the advancement of knowledge and the pursuit of truth, and the advancement of the process of democracy in our country. The violation of the public interest and the legitimate rights and interests of others often occurs. Therefore, it is becoming more and more necessary to clear the legal boundary of freedom of speech from the media. From the description of the related concepts of media speech, and the analysis of the cases related to self media speech in recent years, it presents a dispute between the boundary of the media speech and other rights, as well as the restrictions on the freedom of speech in other countries, and then analyzes the status and shortcomings of the measures for protecting and restricting self media speech. The two aspects of the law and the self-discipline of the industry put forward the feasible suggestions to make the free speech rights exerciser right and protected within the scope of their rights. The authorities of the relevant authority restrict them when they transcend the scope of the exercise of rights, and grasp the degree of limitation, and finally make the media speech develop in a more standardized direction. The author thinks that the law is in a more standard direction. The essence of the boundary is the question of the relationship between freedom and order. In the game of freedom and order, the balance between the two is found, the best state of the two coexistence is realized, and the freedom of speech of citizens is realized to the maximum.
