法律地理学:渊源、现状与展望

【摘要】：法律地理学作为一门学科已经在英国、美国、德国、澳大利亚等国获得广泛认同,其旨在研究人、空间、法律之间存在的相互建构关系。法律地理学采用地理学中空间分异、空间结构、地理制图等方法研究法律现象,但目前该学科对"空间"这一范畴仍缺乏统一的认识。空间包括场所空间和领域空间,法律地理学的建构可以基于具象和抽象两类空间展开,法律地理学在具象和抽象层面对法律与空间之间关系所作的研究有助于获得一种新的法学研究路径。
[Abstract]:As a subject, legal geography has been widely recognized in Britain, the United States, Germany, Australia and other countries. Its purpose is to study the relationship between human, space and law. Legal geography studies legal phenomena by means of spatial differentiation, spatial structure and geographical mapping in geography, but there is still a lack of unified understanding of the category of "space" in this subject. Space includes place space and domain space. The construction of legal geography can be based on two kinds of space: concrete space and abstract space. The study of the relationship between law and space in the concrete and abstract aspects of legal geography is helpful to obtain a new path of legal research.
