唐代赦免制度法律分析

【摘要】：赦免制度作为一项重要的法律制度,在我国历史悠久,是古往今来众多学者研究的热点。唐代,作为古代中国封建政治发展的顶峰,其赦免制度亦是闪烁着夺目的光辉。在当今社会热议“大赦”、“特赦”问题时,笔者从唐代的赦免制度的分类、制度构建、法律效果、法律价值多个角度入手,对其进行研究分析,期望在借鉴前人研究成果基础之上,一展唐代赦免制度之风采,为当代法制建设提供参考、借鉴。本文共分为三大部分,绪论、正文、结语。绪论部分,简要介绍本文的选题缘起、相关学术研究成果的文献综述以及本文的研究方法与创新。正文部分,第一章探究赦免的含义、唐之前赦免制度的发展概况。第二章,以效力范围和原宥程度为标准,对唐代赦免进行分类,且从赦免的提起、诏书草拟、赦免仪式等方面介绍唐代赦免的程序。第三章,运用法学“四维度”论,从时间、空间、人、事四个方面探讨赦文的法律效力范围,然后又结合《唐律疏议》有关赦免条文进行分析,突出律令在赦免制度中所起到的赦前、赦后双重限制作用,完整地呈现政治赦文和法律律令二者在互相融合基础之上,所构建的唐代赦免制度。第四章,从刑事、民事、行政三个方面介绍唐代赦免的法律效果。第五章,分别归纳了唐代赦免的理论价值和诉讼价值。最后,余论部分,在全文研究基础之上,对我国现代赦免制度提出作者的建议。
[Abstract]:As an important legal system, the pardon system has a long history in China and has been a hot research topic for many scholars throughout the ages. Tang Dynasty, as the peak of feudal political development in ancient China, its pardon system is also shining brilliant. In today's society, when discussing the issue of "amnesty" and "amnesty", the author analyzes the classification, construction, legal effect and legal value of the amnesty system in the Tang Dynasty. On the basis of the previous research results, the author hopes to show the style of the amnesty system in Tang Dynasty and provide reference for the construction of contemporary legal system. This paper is divided into three parts, introduction, text, conclusion. In the introduction part, the author briefly introduces the origin of the topic, the literature review of relevant academic research results, and the research methods and innovations of this paper. The first chapter explores the meaning of pardon and the development of amnesty system before Tang Dynasty. The second chapter classifies the amnesty in Tang Dynasty according to the scope of validity and the degree of forgiveness, and introduces the procedure of pardon in Tang Dynasty from the aspects of the introduction of pardon, the drafting of imperial edict, the ceremony of pardon and so on. The third chapter, using the theory of "four dimensions" of law, discusses the scope of legal effect of pardons from four aspects of time, space, person and matter, and then analyzes the pardons in the light of "Tang Ru-Shu". Highlighting the double restriction effect of law and order in the amnesty system before and after pardoning, the article of political amnesty and the law decree, on the basis of merging each other, constructed the pardon system of Tang Dynasty. Chapter four introduces the legal effect of amnesty in Tang Dynasty from three aspects: criminal, civil and administrative. Chapter five summarizes the theoretical value and litigation value of amnesty in Tang Dynasty. Finally, on the basis of the full study, the author's suggestions on the modern amnesty system are put forward.
