清朝满族婚姻缔结法律制度研究

【摘要】：满族作为中国的少数民族,有着其自身的民族文化特色,因此它的政治、经济、文化等方面都有其独特的文化底蕴。并且作为清王朝的建立者,统治中国长达二百余年,它自身的制度影响着整个清王朝的建设与发展。要了解一个民族的政治、经济和文化,就需要找寻一个入口,而婚姻制度就是这一入口的答案。而目前对于民族的研究多是从历史文化方面的研究,所以对满族婚姻缔结的法律制度进行研究,是一个比较新的方面,可以从另一个角度对满族进行重新认识。清朝是中国最后一个封建王朝,它的制度建设有前朝的经验教训和满族的民族制度为铺垫,这使得统治者更加运筹帷幄,全面细致地对清王朝进行制度建设。而这些制度的建设也当然离不开满族人民智慧的结晶,从这一方面也可以看出对清朝满族进行研究的价值所在。婚姻制度是一项上至皇室贵族下至平民百姓都必须参与的重要制度,无论是清朝的满族皇室,还是普通的旗人都离不开婚姻缔结这一必需选项,所以说婚姻作为社会关系网基石而存在是必然的,小家的聚集才能构建清王朝这一大家庭。清朝满族婚姻缔结相关法规律例分散规定在《大清律例》、《户部则例》、《大清会典》等法典中,各地方县志也有所涉猎,如《新宾县志》、《宽甸县志》等。《啸亭杂录》、《清稗类钞》、《柳边纪略》等史学书籍也对清朝满族婚姻制度的规定进行了一定的叙述,但是并没有完整的法典来规定清朝满族婚姻制度。本文以清朝满族婚姻缔结的法律制度为研究对象,通过对清朝满族婚姻缔结的成立条件、特殊法律规定和对其的评价和启示等三个方面对清朝满族婚姻缔结的法律制度进行了一系列的论述。在对清朝满族婚姻缔结的法律制度的研究中,有对普遍性婚姻缔结的法律规定的研究,也有对皇室中帝后大婚的法律规定的叙述。通过对这些法律制度的认真学习,可以了解到对清朝满族婚姻缔结进行法律规定对婚姻的质量、统治者的统治、民族的融合等方面均有受益,同时也对当代婚姻制度有了一定的启示,尤其是现代婚姻中屡次出现的彩礼问题。
[Abstract]:Manchu, as a minority in China, has its own national cultural characteristics, so its political, economic, cultural and other aspects have their own unique cultural heritage. As the founder of the Qing Dynasty, it ruled China for more than 200 years, and its own system affected the construction and development of the whole Qing Dynasty. To understand a nation's politics, economy, and culture, one needs to find an entrance, and the marriage system is the answer. At present, the study of nationality is mostly from the aspect of history and culture, so it is a relatively new aspect to study the legal system of marriage conclusion of Manchu nationality, and we can reunderstand Manchu nationality from another angle. The Qing Dynasty was the last feudal dynasty in China, and its system construction was paved by the experience and lessons of the previous dynasties and the Manchu ethnic system, which made the rulers more resourceful and comprehensive and meticulous in the system construction of the Qing Dynasty. The construction of these systems is certainly inseparable from the crystallization of the wisdom of the Manchu people, from which we can see the value of the Manchu research. Marriage system is an important system from royal aristocrats to ordinary people. Whether it is Manchu royal family in Qing Dynasty or ordinary flag people, marriage is an essential option. Therefore, marriage as the cornerstone of social relations is inevitable, the gathering of small families to build the Qing dynasty this family. In the Qing Dynasty, the Manchu marriage and marriage related laws and regulations were scattered and stipulated in the laws and regulations of the Qing Dynasty, the rules of the Ministry of Household, and the Code of the Qing Dynasty, and the local and county records were also dabbled in. For example, "Xinbin County Records", "Kuandian County Records", "Xiao Ting Miscellaneous Records", "Qing Paspalum banknotes", "Liu Bian Ji Li" and other historical books also gave a certain description of the Manchu marriage system in the Qing Dynasty. However, there is no complete code to regulate the Manchu marriage system in the Qing Dynasty. This article takes the legal system of the marriage of Manchu nationality in Qing Dynasty as the research object, through the establishment condition of the marriage of Manchu nationality in Qing Dynasty, The special legal provisions and the evaluation and enlightenment of the Manchu marriage in Qing Dynasty were discussed in a series of aspects. In the study of the legal system of the Manchu marriage in the Qing Dynasty, there is a study on the legal provisions of the universal marriage, and also a description of the legal provisions of the royal marriage between the emperor and the emperor. Through careful study of these legal systems, we can learn that the legal provisions on the marriage of Manchu nationality in the Qing Dynasty have benefited from the quality of marriage, the rule of rulers, the integration of nationalities, and so on. At the same time, there are some enlightenment to contemporary marriage system, especially the problem of bride price in modern marriage.
