社会主义法治理念的价值选择

【摘要】：马克思·恩格斯·列宁等马克思主义的经典著作家都是对人类产生了巨大影响的历史巨人,他们的法律学说现在仍然在指导着我国的法治建设的实践。新中国成立以后,党的历代领导人也都十分重视中国的法治建设,十五大上明确提出了"依法治国,建设社会主义法治国家"的基本治国方略。胡锦涛同志在继承马克思主义法律思想基础上,在结合我国改革开放的实践过程中。提出了社会主义法治理念。通过我的论文的写作,争取能够充分论证马克思主义法理念的深刻内涵和社会主义法治理念的价值选择的必然性及价值选择的目标,充分认识树立社会主义法治理念的重要性及其现实意义和理论意义,坚持党对政法工作的坚定领导,在全社会营造良好的法治环境。对马克思主义法理念和社会主义法治理念的进行研究历来受到广大知识精英们的重视,这不仅对马克思主义法律思想研究的深入推进十分有利,也对我国的改革开放和社会主义现代化建设有重要的理论和现实意义。国内如孙国华,黎国智,吕世伦,俞荣根,卓泽渊,张文显,付子堂等新老专家都对马克思主义法律思想有过专门研究,越来越多的研究生同学们也把自己的主要的研究方向定位在对马克思主义法理思想的研究上,并涌现出了许多优秀硕士论文,博士论文。论文以马克思主义经典著作为基础,以发展着的马克思主义的最新成果为指导,并且时刻牢记中国的现实国情,忠实原著,注重背景,全面系统的进行自己的论文研究。对马克思主义法律思想的研究,必须要坚持历史唯物主义和辩证唯物主义的世界观和方法论。 本文分三个部分对社会主义法治理念的价值选择展开论述。 第一部分,论述了马克思主义法理念在指导社会主义实践中的运用。马克思主义法理念的首次尝试是在巴黎公社时期。在苏联建立以后,包括列宁,斯大林等国家领导人在建立苏联以及建设苏联的过程中也在逐步探索马克思主义法理念在苏联的应用。新中国建立以后,毛泽东,邓小平,江泽民,胡锦涛等几代领导人也在逐步探索中国特色的法律制度,建设社会主义的法治文明。 第二部分,论述社会主义法治理念的价值选择的必然性及其价值选择的目标。对价值这个概念进行了介定,并阐述了价值选择的社会基础、政治基础、经济基础,并论证了依法治国,公平正义,执法为民,服务大局和党的领导的关系。 第三部分,阐述社会主义法治理念的理论意义与实践意义。本部分内容主要是针对审判,检察,律师等工作过程中在学习与运用社会主义法治理念的实践过程。审判,检察,律师等工作都应该自觉的学习和贯彻落实社会主义法治理念,做中国特色社会主义法治事业的坚定地拥护者和建设者。
[Abstract]:Marx Engels Lenin and other classic writers of Marxism are historical giants who have a great influence on human beings. Their legal theories still guide the practice of the construction of the rule of law in our country. Since the founding of the people's Republic of China, the leaders of the past generations of the Party have also attached great importance to the construction of the rule of law in China. At the 15th National Congress of the Communist Party of China, the basic strategy of "governing the country according to law and building a socialist country ruled by law" was clearly put forward. On the basis of inheriting Marxist legal thought, Comrade Hu Jintao combines the practice of reform and opening up in China. Put forward the idea of socialist rule of law. Through the writing of my thesis, I strive to fully demonstrate the profound connotation of Marxist legal concept, the inevitability of the value choice of the socialist concept of rule of law and the goal of the value choice. Fully understand the importance of the concept of socialist rule of law and its practical and theoretical significance, adhere to the party's firm leadership in the work of politics and law, and create a good environment for the rule of law in the whole society. The study of Marxist legal concept and socialist legal concept has always been attached great importance to by the vast knowledge elite, which is not only beneficial to the further research of Marxist legal thought, Also has important theoretical and practical significance to our country's reform and opening up and socialist modernization construction. Domestic experts such as Sun Guohua, Li Guozhi, Lu Shilun, Yu Ronggen, Zhuo Zeyuan, Zhang Wenxian, Fu Zitang and other new and old experts have all made special research on Marxist legal thought. More and more graduate students also put their main research direction in the study of Marxist jurisprudence, and emerged many excellent master thesis, doctoral thesis. The thesis is based on the classic works of Marxism, guided by the latest achievements of the developing Marxism, and always bear in mind the reality of China, faithful to the original works, pay attention to the background, comprehensive and systematic study of their own papers. To study Marxist legal thought, we must adhere to the world outlook and methodology of historical materialism and dialectical materialism. This paper is divided into three parts to discuss the value choice of the socialist concept of rule of law. The first part discusses the application of Marxist legal concept in guiding socialist practice. The first attempt at the idea of Marxist law was during the period of the Paris Commune. After the establishment of the Soviet Union, the leaders of Lenin, Stalin and other countries also gradually explored the application of Marxist legal concepts in the Soviet Union in the process of establishing the Soviet Union and building the Soviet Union. After the founding of New China, several generations of leaders, such as Mao Zedong, Deng Xiaoping, Jiang Zemin, Hu Jintao and so on, are also gradually exploring the legal system with Chinese characteristics and building socialist civilization of ruling by law. The second part discusses the inevitability of the value choice of the socialist legal concept and the goal of the value choice. This paper introduces the concept of value, and expounds the social basis, political foundation and economic basis of value selection, and demonstrates the relationship between ruling the country by law, fairness and justice, law enforcement for the people, serving the overall situation and the leadership of the Party. The third part expounds the theoretical and practical significance of the concept of socialist rule of law. This part is mainly aimed at the practical process of studying and applying the idea of socialist rule of law in the process of trial, procuratorial work, lawyer and so on. Trial, procuratorial, lawyer and other work should consciously study and implement the socialist concept of rule of law, and be a staunch advocate and builder of the cause of socialist rule of law with Chinese characteristics.
