论韩国的法定继承制度及其对我国的启示

【摘要】：韩国政府早在1958年就颁布了《大韩民国民法典》,确立了法定继承制度。几经修改的现行的韩国法定继承制度在立法体系和内容方面都具有自己的特色。比较中韩两国的法定继承制度发现,将父母、子女和配偶等近亲属规定为法定继承人,重视子女和配偶的法定继承顺序,保护孙子女的代位继承权等方面的规定是相同的。但是两国法律制度的区别也是显著的。韩国法律所规定的法定继承人的范围扩大到直系血亲、配偶亲及4寸以内的旁系血亲;法定继承规定为四个继承顺序,并规定配偶为零顺序;将直系血亲的配偶和兄弟姐妹的子女扩大为代位继承人;分割遗产时照顾对被继承人有贡献的继承人以及特别收益的返还制度等内容,对我国继承立法的修改与完善都具有较好的借鉴意义。
[Abstract]:The Korean government promulgated the Republic of Korea Civil Code as early as 1958 and established the system of statutory succession. The current legal succession system of Korea has its own characteristics in legislative system and content. By comparing the legal inheritance system between China and South Korea, it is found that the provisions concerning the legal succession order of children and spouses and the protection of the right of subrogation of grandchildren are the same as those of the near relatives of parents, children and spouses as legal heirs. But the differences between the two countries' legal systems are also significant. The scope of legal heirs stipulated in Korean law is extended to direct blood relatives, spouse relatives and blood relatives within 4 inches, and legal succession is defined as four succession orders and zero order for spouses; The expansion of the children of the spouse and siblings of the immediate lineage to subrogation, the care of heirs who contribute to the deceased in the division of the estate and the system for the return of special proceeds, etc., It has good reference significance to the revision and perfection of inheritance legislation in our country.
