论法的和谐美

【摘要】:相反相成,对立统一,是形成和谐的根本原因。简单来说,所谓“和谐”,就是矛盾对立的统一,杂多因素的相济。和谐源于人性的根本需求,是人类社会永恒的价值追求。 依据马克思在《1844年经济学——哲学手稿》中的思想,建立在劳动基础上的人化自然过程是一个自然的人化、人的自然化的过程,它是整个人类文明的源泉。美就根源于人化自然过程人的本质力量的对象化,它是人以直观的方式对其本质的把握。人的本质力量指人在“自由自觉的活动”所能表现出的一切力量,它体现着人的主观能动性对物质世界客观规律的把握,并在这种把握中由对立走向统一。因此,美就是和谐,就是主观与客观、真与善在对立中的统一,是人与自然、感性与理性诸杂多因素的相济。 法,作为人类经验智慧结晶之一种,其产生发展也体现着人的本质力量的不断提升。因此,法中不仅有真、有善,还有美。和谐既是美的主要特征,又是法的价值追求,它构成法与美的一个交汇点。法之和谐美就是真与善、感性与理性、人的主观目的与客观物质规律的和谐之美。它取决于人性与生产方式在法律中的“耦合”,体现着人性与生产方式在双向互动中的均衡。 在远古时代,法与美最初的融合体现在古诗体法中。在法律以后的发展走向中,中西方呈现出了不同的法律样态,但和谐始终是其共同不变的价值追求。法之和谐美在中国的发展表现为“礼法的和谐之治”,在西方得益于众多法学流派的相互碰撞与融合。 法之和谐美既体现为法的价值之美,表现在法的伦理灵魂,及其对秩序与正义的整体追求上,并具体落实为法对人与自我、人与自然、人与社会的调节。同时,法之和谐美又彰显于法的严整形式之中,具体体现在法律体系、法律规则及法律程序设置自身及其相互之间和现实化运作过程中的统一协调。最后,法之和谐美还体现为价值与形式的辩证统一。包括权力与义务、权利与权力、权力与责任这些矛盾范畴本身的相反相成及相互之间的共依共存。

Beauty is rooted in the objectification of the essential power of human beings in the humanized natural process, which is the essence of human beings in an intuitive way. Man's essential power refers to all the powers that man can display in his "free and conscious activities". It embodies man's subjective initiative in grasping the objective laws of the material world and in this grasp from opposition to unity. The combination of sensibility and reason is mixed with many factors.
Law, as one of the crystallization of human experience and wisdom, its emergence and development also reflects the continuous improvement of human essential strength. Therefore, there is not only truth, goodness, but also beauty in law. Harmony is not only the main feature of beauty, but also the pursuit of value of law. It constitutes a intersection point of law and beauty. The harmonious beauty of law is truth and goodness, sensibility and rationality, and man's master. The beauty of harmony between objective object and objective material law depends on the coupling of human nature and mode of production in law, which reflects the balance between human nature and mode of production in the two-way interaction.
In ancient times, the initial fusion of law and beauty was embodied in the ancient poetic law. In the development trend after law, China and the West showed different patterns of law, but harmony has always been their common and unchangeable pursuit of value. The collision and integration of each other.
