事理、法理与社科法学

【摘要】：《法治及其本土资源》曾给法学界带来一股清风,其写作方式与同时期的法学作品颇为不同,它着眼于"从事理讲法理",而不是抽象地讲法理。从事理出发,走向从中国社会出发、尊重社会创造的法理,这才是真正意义上的中国法理研究。这种研究诉诸常情、常理、常识,讲述的是生活经验,而背后有理论视角,需要理论资源储备,也需要社会科学知识和方法的运用,它最终会走向社科法学。社科法学研究的重要任务之一是重建中国法理学,在一般性法律现象、法律关系之外讨论中国的法律体制、法律运行等问题,在经验基础上阐释中国法治实践。
[Abstract]:"Rule of law and its native resources" once brought a breeze to the legal circles, and its writing style is quite different from the legal works of the same period. It focuses on "engaging in the theory of law", rather than talking about the theory of law in an abstract way. Starting from the Chinese society and respecting the legal principles created by the society, this is the real study of Chinese jurisprudence. This kind of research appeals to the common sense, is about the life experience, but behind the theory angle of view, needs the theoretical resources reserve, also needs the social science knowledge and the method application, it will eventually go to the social science law. One of the important tasks of the study of social science law is to reconstruct Chinese jurisprudence, discuss Chinese legal system and legal operation outside of general legal phenomena and legal relations, and explain the practice of Chinese rule of law on the basis of experience.
