思想政治教育法治化研究

【摘要】： 思想政治教育法治化是指在宪法和法律的范围内，建立和完善思想政治教育的法律、法规和制度体系，依法进行思想政治教育活动，使思想政治教育处于依法治理的状态之中。思想政治教育法治化就是要使我国的思想政治教育制度化、规范化，具有可操作性和说服力，增强思想政治教育的有效性，克服思想政治教育中的人治倾向和随意化倾向，保护合法的思想道德自由。它是提高思想政治教育的有效性，充分发挥其“生命线”作用的保证，也是依法治国的客观要求。思想政治教育法治化的研究在理论和实践上对思想政治教育都是意义极其重大的。 本文从理论和实施两个方面对思想政治教育法治化进行了探讨。首先从我国依法治国的基本国策、思想政治教育自身的可调控性和它的宪法法律基础等方面论述了思想政治教育法治化的前提条件；接下来分别对思想政治教育法治化的必然性和可行性进行了论证。思想政治教育法治化的必然性表现在它是社会主义市场经济的必然要求、社会主义主导意识的必然趋势、社会主义政治文明的必然结果及其自身创新的必然结论等四个方面。思想政治教育法治化的可行性表现是在哲学、政治学、法律等各个领域都有它存在的可行性理论基础。 本文把思想政治教育法治化的具体实施分为三个方面进行研究，即思想政治教育内容的法治化、实施手段的法治化和管理的法治化。在思想政治教育法治化的实施过程中，前提是要建立和完善思想政治教育内容、实施手段和管理等各个方面的法律法规制度，使其有法可依，但关键是要严格依法进行，，在进行思想政治教育中以法律为准、为上。思想政治教育法治化不是限制思想自由的枷锁，而是限制人治、限制随意、保护思想自由 西南交通大学硕士研究生学位论文 第OI 页 的武器。对思想政治教育法治化具体实施的成败评判，我们必须坚持以“三 个代表”和人的全面发展这两个标准。
[Abstract]:The legalization of ideological and political education refers to the establishment and perfection of the laws, regulations and systems of ideological and political education within the scope of the Constitution and the law, and the conduct of ideological and political education activities in accordance with the law, so as to make the ideological and political education in a state governed by the law. The feasibility of the rule of law in ideological and political education is the theoretical basis of its existence in philosophy, politics, law and other fields. In this paper, the concrete implementation of the rule of law of ideological and political education is divided into three aspects: the legalization of the content of ideological and political education, the legalization of the means of implementation and the legalization of management. In the process of implementing the rule of law in ideological and political education, the prerequisite is to establish and perfect the legal and regulatory systems in all aspects of ideological and political education, such as the content of ideological and political education, the means of implementation and management, etc., so that they can abide by the law, but the key is to carry out it strictly in accordance with the law.
