中华传统法文化精髓及当代价值研究

【摘要】：中华传统法文化精髓是中华法律实践和理论的历史沉淀的优秀成果,具有强烈的民族特性。近现代以来,中华传统法文化受到来自西方法治文明理念的强烈冲击,在制度层面上已逐渐消融瓦解,但制度背后的精神文化理念依然深刻地影响着人们的思维习惯和行为方式。一国的法治建设必须建立在本民族的习惯之上,与民众普遍的法文化相适应。因此,我们在推进法治建设过程中,必须深入挖掘中华传统法文化的优秀资源。文章在剖析当前法治建设对中华传统法文化的现实需求的基础上,重点从国家、社会、个人三个层面论述了中华传统法文化中"和合思想""仁文化"和"礼文化""义利诚信"等思想精髓及其当代价值体现,并探讨了中华传统法文化价值转化的方式和途径。
[Abstract]:The essence of Chinese traditional law culture is the outstanding achievement of the historical precipitation of Chinese legal practice and theory, and has strong national characteristics. Since the modern times, the traditional Chinese legal culture has been strongly impacted by the western civilization of rule of law, and has gradually melted and collapsed at the institutional level. However, the spiritual and cultural ideas behind the system still profoundly affect people's thinking habits and behavior patterns. The construction of a country's rule of law must be based on the customs of its own nation and adapt to the common legal culture of the people. Therefore, in the process of promoting the construction of rule of law, we must dig into the excellent resources of Chinese traditional law culture. On the basis of analyzing the realistic demand of the current construction of the rule of law for Chinese traditional law culture, the article focuses on the country and society. This paper discusses the essence and contemporary value of "harmony thought" benevolence culture "and" courtesy culture "," righteousness and benefit honesty "in Chinese traditional law culture from three aspects, and probes into the ways and means to transform the value of Chinese traditional law culture.
