关于事实解释的规则——从自发秩序到规范系统

【摘要】：事实解释,是指将生活事项予以陈述、剪除、评价,以及推动事实与规范的流转往返。本文以对个案的参与式考察和多维度解读为主线,通过发掘自生自发秩序,提炼出事实解释的三大规则。首先透过常识的规则化潜质,引出事实解释的前置性假说—有限事实规则。随后通过对事实解释三大模型的利弊剖析,推演出事实解释的功能性选择—依过错分配不利事实解释规则。最后开示了事实解释的统领式方略—优越利益保护规则。
[Abstract]:The interpretation of facts refers to the statement, cutting, evaluation, and promotion of the flow of facts and norms. This paper takes the participatory investigation and multi-dimensional interpretation of the case as the main line and extracts the three rules for the interpretation of facts by exploring the spontaneous order of spontaneity. Firstly, through the regularization potential of common sense, the presupposition hypothesis of fact interpretation-the rule of finite fact is introduced. Then, by analyzing the advantages and disadvantages of the three models of fact interpretation, the paper deduces the functional choice of fact interpretation-the rule of unfavorable fact interpretation according to fault. At last, it shows the dominant strategy of fact explanation-the rules of protecting superior interests.
