美国反倾销年度复审制度探析及对我国的借鉴意义

【摘要】：反倾销年度复审制度是美国特有的反倾销行政复审制度之一,其主要目的是通过行政复审的程序来确定反倾销裁定是否有继续存在的必要性和合理性,涉及到反倾销税令的存废问题。在结构上,本文共分三章对美国反倾销年度复审制度的程序、内容、结果及相应的司法救济手段等进行介绍,分析反倾销年度复审制度的合理性、优越性及不足之处,进而指出美国年度复审制度对我国的借鉴意义。 第一章,通过对反倾销复审制度的整体介绍,以及反倾销复审制度和其他相关概念的区别,旨在对年度复审制度进行一个宏观的认识。 第二章,本章节共分四个部分。第一部分通过年度复审与其他种类复审程序进行比较,阐明反倾销年度复审的立法和程序。第二部分对反倾销年度复审中对倾销幅度、进口数量的可能性裁定进行介绍,并进而得出反倾销年度复审与反倾销税令取消之间的关系。第三部分就美国的反倾销年度复审裁定提出相应的救济方式。第四部分在前面阐述的基础上对反倾销年度复审制度进行评价。 第三章,本章是在第一、二章的基础上,通过对美国反倾销年度复审制度的介绍和分析,阐述美国反倾销年度复审制度对我国的借鉴意义。
[Abstract]:The antidumping annual review system is one of the special anti-dumping administrative review systems in the United States. Its main purpose is to determine the necessity and reasonableness of the antidumping ruling through the procedure of administrative review. It involves the retention and abolition of anti-dumping duties. In structure, this article divides into three chapters to introduce the procedure, content, result and the corresponding judicial relief means of the American anti-dumping annual review system, and analyzes the rationality, superiority and deficiency of the anti-dumping annual review system. Then points out the American annual review system to our country's reference significance. The first chapter, through the whole introduction of the anti-dumping review system, and the difference between the anti-dumping review system and other related concepts, aims to make a macro understanding of the annual review system. Chapter two, this chapter is divided into four parts. The first part clarifies the legislation and procedure of antidumping annual review by comparing annual review with other kinds of review procedures. The second part introduces the possibility of dumping margin and import quantity in the annual review of anti-dumping, and then obtains the relationship between the annual review of anti-dumping and the cancellation of anti-dumping duty order. In the third part, the author puts forward the corresponding remedies for the American annual review of anti-dumping. The fourth part evaluates the anti-dumping annual review system on the basis of the previous elaboration. The third chapter, this chapter is based on the first and second chapters, through the introduction and analysis of the American anti-dumping annual review system, expounds the American anti-dumping annual review system to our country's reference significance.
