经济法是什么——经济法的法哲学反思

【摘要】：法部门的不同主要在于其解决的社会问题不同,以及由此引起的法的目的、法规范的行为、法的规则形式以及法规范工具的不同。经济法产生和发展的社会经济背景决定了其解决的问题是社会经济整体发展的问题,其保护的利益是经济公益及作为其基础的社会经济秩序。经济法主要规范的是经济公害行为。经济公害行为损害的特性,决定了经济法采取的规则形式主要是以预防为主的事前规制规则。同时,社会经济秩序本身的动态性特点,对其状态评判标准的非纯客观性,以及作为公共物品的特性,决定了对其维护的较妥切工具是社会责任。因而,经济法的研究不应遵循以个体权利为中心的主流法研究范式,而应以社会责任为中心,以对经济公害行为的防范为目的重建自身的体系。
[Abstract]:The difference of law department mainly lies in the different social problems it solves, the purpose of law, the behavior of legal norm, the form of rule of law and the instrument of legal norm. The social and economic background of the emergence and development of economic law determines that the problem to be solved is that of the overall development of social economy, and that the interests of its protection are the economic public good and the social and economic order on which it is based. The main norm of economic law is the behavior of economic pollution. The characteristics of the damage of economic pollution behavior determine that the rule form of economic law is mainly the rule of prevention. At the same time, the dynamic characteristics of the social economic order itself, the non-pure objectivity of its state evaluation criteria and its characteristics as public goods determine that the proper tool for its maintenance is social responsibility. Therefore, the study of economic law should not follow the mainstream research paradigm of individual rights, but should focus on social responsibility and rebuild its own system in order to prevent economic pollution behavior.
