文明转型与中国特色法治发展之路

【摘要】：新中国建立之前,中国一直没有完成由农耕文明政治统治向商工文明的法律治理的转型。在中国共产党领导下,经过艰难探索,伴随着改革开放,中国展开了法治建设的历程。因各种历史性因素的影响,当代中国法治之路有自己的特点,它们包括:由中国共产党领导和推进;以人民代表大会制度为基本制度依托;在赋予政府巨大责任和权力的同时对其加以必要约束限制;在对中国传统法文化扬弃的过程中不断走向成熟。
[Abstract]:Before the founding of New China, China had not completed the transformation from the political rule of farming civilization to the legal governance of commercial and industrial civilization. Under the leadership of the Communist Party of China, with the reform and opening up, China began the process of building the rule of law.
