以民法为中心的体育法——对意大利体育法教学与研究的初步观察

【摘要】：在意大利高校,体育法课程由法律系组织,分大学选修课程和成人进修课程两种,外聘专业的体育法律师作为教师,教学内容侧重于民事体育法。体育法研究在意大利有着近百年的悠久历史,选题虽然多元,但研究重心亦在民事体育法上。判例评论是意大利体育法研究的一大特色,法教义学则是研究的主要方法。中国的体育法教学与研究有自身特色,但也可以从意大利的经验中得到有益启示。
[Abstract]:In Italian colleges and universities, sports law courses are organized by the law department, which are divided into two kinds: elective courses and adult continuing courses. The external professional sports law lawyers are teachers, and the teaching contents are focused on civil sports law. The study of sports law has a long history of nearly 100 years in Italy. Although the topics are diverse, the research focus is also on civil sports law. Case review is a major feature of Italian sports law research, while legal dogmatics is the main research method. Chinese sports law teaching and research have their own characteristics, but also from the experience of Italy to get useful inspiration.
