明代法律文书研究

【摘要】：明代在我国古代史上是一个较为特殊的朝代,它是继汉唐之后强盛的大一统中原王朝,也是我国古代封建社会最后一个汉族王朝。明代特别重视利用法律来整顿吏治和维护封建统治,其商品经济、文化和科技也空前繁荣,在我国古代史上处于鼎盛地位。这一切都为明代法律文书的发展提供了条件和基础。本论文结合明代历史背景下的法律活动,综合当时的政治、经济、文化等因素,从立法、司法、执法等方面对这一时期法律文书的发展状况进行分析。明代的立法文书主要有律、令、诰、例等,司法文书主要有诉状和判词等,执法文书主要有契约等。通过对法律文书文献资料的收集、分析和解释,以历史的视角展现明代法律文书的原貌,揭示它的特点。
[Abstract]:The Ming Dynasty is a special dynasty in the ancient history of our country. It is a powerful central Plains dynasty after the Han and Tang dynasties. It is also the last Han dynasty in the ancient feudal society of our country. The Ming Dynasty attached great importance to the use of law to rectify the administration of officials and maintain feudal rule, its commodity economy, culture and science and technology were also unprecedented prosperity, in the ancient history of our country in a prosperous position. All these provide the conditions and foundation for the development of Ming Dynasty legal documents. This paper combines the legal activities under the historical background of the Ming Dynasty, synthesizes the political, economic, cultural and other factors at that time, and analyzes the development of the legal documents in this period from the aspects of legislation, judicature, law enforcement and so on. The legislative documents of Ming Dynasty mainly have laws, orders, Letters Patent, examples and so on, judicial documents mainly have pleadings and judgments, and law enforcement documents mainly have contracts, etc. Through collecting, analyzing and explaining the documents of legal documents, this paper presents the original features of legal documents of Ming Dynasty from the historical perspective and reveals its characteristics.
