中国法治评估指标体系的价值基准

【摘要】：随着中国法治进程的不断推进,法治评估活动不断兴起,法治评估指标体系的设计成为研究者关注的焦点,但鲜有学者对中国法治评估指标体系的价值基准作出探讨与解析。建立中国法治评估指标体系的价值基准的选择条件,需遵循"良法之治的价值向度"、"兼顾法治普遍性与特殊性"、"与规范维度之间的可转换关系"。结合中国自身法治语境的特征,法治评估指标体系的价值基准包括"法律至上"、"权力规制"、"法制健全"、"程序正当"、"民主与形式平等"、"权利保护"及"正义与合道德性"七项构成要素。法治评估指标体系的价值基准也具有开放性,可以接纳与吸收中国新的本土法治伦理价值。
[Abstract]:With the continuous advancement of the process of rule of law in China, the evaluation of the rule of law continues to rise, and the design of the index system of the evaluation of the rule of law has become the focus of attention of the researchers, but few scholars have discussed and analyzed the value benchmark of the index system of the evaluation of the rule of law in China. In order to establish the value criterion of the evaluation index system of rule of law in China, we should follow "the value direction of good law governance", "take into account the universality and particularity of the rule of law", and "the transferable relationship between the standard dimension and the rule of law". In combination with the characteristics of China's legal context, the value criteria of the evaluation index system of the rule of law include "law first", "power regulation", "legal perfection", "due process", "democracy and formal equality". Protection of Rights and Justice and morality constitute seven elements. The value benchmark of the index system of rule of law is also open, which can accept and absorb the new local ethical value of rule of law in China.
