论中国古代盟誓法律制度及其当代变形

【摘要】：中国古代盟誓制度起源于黄帝时代,定型于西周时期,它在本质上是一种政治制度和神灵崇拜,更是一种特殊的法律制度、法律行为和法律事实,因而具有重大的法律价值;古代盟誓至今仍以其变形存在并制约着国家、国际与人际等关系,具有正负两面价值。
[Abstract]:The ancient Chinese vows system originated in the Yellow Emperor period and shaped in the Western Zhou Dynasty. In essence, it is a kind of political system and worship of gods, but also a special legal system, legal acts and legal facts, so it has great legal value. The ancient vows still exist and restrict the relationship between nation, international and interpersonal by its deformation, which has both positive and negative value.
