人权的冲锋战士——简论法国的《人权宣言》

【摘要】：1789年,法国国民议会通过了一部具有宪法性质的自由权利宪章,即《人权与公民权宣言》。宣言不仅是法国历史上的第一部人权宣言,也是人类历史上第一部正式的人权宣言,具有极其重要的历史意义。其所确立的人民主权原则、同等权利原则、分权原则、权利保障原则、无罪推定原则等重要原则,成为宪政主义理论的核心。本文旨在系统简要地描绘出当时《人权宣言》出现的理论渊源、基本内容及历史意义。
[Abstract]:In 1789, the French National Assembly adopted a constitutional charter of freedom, the Declaration of Human and Citizenship. The declaration is not only the first declaration of human rights in the history of France, but also the first formal declaration of human rights in the history of mankind. The principle of people's sovereignty, the principle of equal rights, the principle of separation of powers, the principle of protection of rights, the principle of presumption of innocence and other important principles have become the core of the theory of constitutionalism. The purpose of this paper is to describe briefly the theoretical origin, basic content and historical significance of the Declaration of Human Rights at that time.
