双重博弈结构下士大夫法律观及现代法治思考

【摘要】:作为社会性的法,法学研究与法律制度构建均需要"本土化"与"人性"的双重历史考量。作为古代社会精英的士大夫,出身于古代宗亲体制下的家庭,积极入仕治国,进可操手法律运行,成为社会治理之中坚;退亦可修身与齐家,是社会结构中"身份利益"与"精神信仰"兼具的最具流动性的群体。该种"身份"与"信仰"双重博弈结构特性衍生出的"强""弱"激励配置,解释了我国古代社会家法何以被预留自治、程序不被重视等问题。中国人的关系存在比法治信仰更为强势束缚现代法治建设,道德化策略难以挽回当今"司法不被信任"的社会心理。制度化策略应是我国新一轮司法改革大背景下法治建设的进路。
[Abstract]:As a social law, both legal research and legal system construction need the dual historical consideration of "localization" and "humanity". As the elite of the ancient society, the literati came from the family under the ancient patriarchal system, actively entered the official country and operated the law, and became the backbone of the social governance. It is the most mobile group in the social structure of "identity interests" and "spiritual beliefs". This kind of "identity" and "belief" double game structure derived from the "strong" and "weak" incentive configuration, explained why the ancient Chinese social family law was reserved for autonomy, the procedure was not attached importance to, and so on. The relationship of Chinese people is more powerful than the belief in the rule of law to restrain the construction of modern rule of law, and the moralization strategy can hardly redeem the social psychology of "judicature is not trusted". The institutionalization strategy should be the way to the construction of the rule of law under the background of the new round of judicial reform in our country.
