冈绍夫封建主义研究的法律路径的新启示

【摘要】：正冈绍夫的封建主义是法律意义上的惯例,一种法律关系或法律制度,即封臣契约(封建契约)衍生的一系列法律权利和义务,主要包括封君与封臣的人身依附关系,封君与封臣对于封土的权利,封土的司法权。对于西欧中世纪史研究,这种法律研究路径可以给我们以新的启示。
[Abstract]:Zhenggang Shaofu's feudalism is the practice in the sense of law, a kind of legal relationship or legal system, namely a series of legal rights and obligations derived from the consecration of vassal (feudal contract), mainly including the personal attachment between the monarch and the vassal. Fengjun and officials of the rights of the feudal land, the jurisdiction of the feudal land. For the study of medieval history in Western Europe, this path of legal research can give us new enlightenment.
