黔东南苗族传统“议榔”立法的生态价值诉求及其现代意义

【摘要】：黔东南苗族通过其传统的"议榔"立法仪式订立了较多的生态保护习惯法,充分表现了黔东南苗族在其传统"议榔"立法中的生态价值诉求。黔东南苗族生态保护习惯法的内容主要包括林木保护、田土保护及水资源保护等几个方面。黔东南苗族在其传统"议榔"立法中强调进行生态保护,主要是基于思想观念、物质利益以及国家制度等几个方面的原因。探析黔东南苗族生态保护习惯法的内容及其立法中生态价值诉求产生的原因,对加强我国的生态保护及完善我国当前的生态保护立法具有一定的启示意义。
[Abstract]:The Miao nationality of southeastern Guizhou made more ecological protection customary laws through its traditional legislative ceremony of "discussing nut", which fully demonstrated the ecological value demand of Miao nationality in its traditional legislation of "discussing nut". The content of ecological protection customary law of Miao nationality in southeast Guizhou mainly includes forest protection, farmland protection and water resources protection and so on. The Miao nationality of Qiandongnan put emphasis on ecological protection in its traditional legislation of "discussion nut", which is mainly based on several reasons, such as ideology, material interests and national system. The analysis of the content of the customary law of ecological protection of Miao nationality in the southeast of Guizhou and the reasons for the demand of ecological value in the legislation have certain enlightenment significance to strengthen the ecological protection of our country and perfect the current legislation of ecological protection of our country.
